Approval recommended subject to the following conditions:
1) The hours of operation will be 1 la.m. to 10 p.m. Monday through Sunday.
2) The sale of beer, wine and alcohol on the premise will be permitted.
3) Final exit door locations will have to be approved by the Building Official.
4) The color of the raceway to match the color of the brick.

HISTORY: Prior to 1982, this property and the property surrounding it were classified
SF-12 on the zoning map. In mid-1982 City Council reclassified the
property surrounding this tract on the west, north and east to the "TC"
Town Center District. On July 9, 1996 City Council approved a zoning
change for this 1-acre parcel and incorporated it into the shopping center
development. City Council approved the final plat for the shopping center
on October 8, 1996.
TRANSPORTATION: Sandy Lake Road is a two-lane asphalt road within a variable width
right-of-way (100' wide in from of the subject property), shown on
the thoroughfare plan as a C4D four-lane divided collector street to
be built within a 110'-wide right-of-way.

COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for
Neighborhood retail uses.
DISCUSSION: The applicant is moving its current Tex-Mex restaurant from Sandy Lake
Plaza to a new and larger lease space at the Town Center Shopping
Center. This will be the fu'st restaurant tenant in this retail strip. The
approved overall site plan for this center shows approximately 58,800 sf
for an anchor tenant, another 24,700 sf of space for retail uses and 7,500
sf for restaurants. This proposed 3,600 sf private club restaurant will
absorb about 48 % of the total restaurant share at this center.
The total seating capacity at this facility is shown to be 160. The
proposed hours of operation are 11:00 a.m. to 10:00 p.m. Monday
through Sunday. The private club portion of this request is to allow the
sale of beer, wine and alcohol on the premise.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
The planning staff recommends approval of this special use permit request subject
to the following conditions being met:
1. Approve proposed hours of operation (11:00 am to 10:00 p.m. Monday
through Sunday).
2. Permit the sale of beer, wine and alcohol on the premise.
3. Final exit door locations will have to be approved by the Building Official.
