PD90-CS 810127 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. ~ ~ -/~- ~ AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission and the Governing Bod.v of the City of Coppell, Texas, in compliance ~Titb the laws of the State of Texas ~ith reference to the granting of zoning changes under the zoning ordinance and zoning map, have ~iven reouisite notices by publication anr~ otherwise, and after boldin~ due bearings and affording a full and fair hearing to all property owners generally, the said Governin~ Body is of the opinion that said change of zoning which is on application of Aubrev Brothers should be granted and the Comprehensive Zoning Ordinance of the City of Coppell should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of CopDe]], Texas, be and the same is hereby amended by amending the Zoning Map of the Cit~ of Coppell, so as to give the hereinafter described ~)roDerty the follo~dr~ zonin~ district classification: Changed from "SF-~.2" Single Family Residential District Classificatio~ to "PD" Planned Development District Classification, said Property beinF described as follows: BEING Tract No. 4, out of the SIBERED HENDERSON SURVEY, Abstract No. 629, in the City of Coppell, Dallas County, Texas, and being described as follows: BEGINNING at an existing iron pipe at the Southeast corner of the C. J. Wilson 100 acre tract; THENCE North 88 degrees 24 minutes 16 seconds West along fence line 612.07 feet to an existing iron Din for corner; THENCE North 2 degrees 26 minutes 12 seconds East 885.25 feet to an existing iron pin; THENCE North 2 degrees 23 minutes East 525.19 feet to an existing iron pin for corner in the South R.O.W. line of Sandy Lake Drive (60 foot R.O.W.); THENCE East along said R.O.W. 612.38 feet to an existing iron pipe for corner; THENCE South 2 degrees 15 minutes West 703.72 feet to an existing iron pin; THENCE South 2 degrees 34 minutes West 723.77 feet to the place of beginning and containing ].9.95 acres of land. Lots within the plan shall average 9,900 s(~uare feet and houses shall be a minimum of ]600 sfluare feet. There shall be a minimum front building line of 30 feet and alleys shall not be reo, uired. Driveways shall be at least 18 feet wide and the length of the block, as shown on the plan, is hereby authorized. /~/o~$~ -/~ ~ ~/~ ~/~--~ SECTION 2. That all ordinances of the City in conflict with the provision of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That the above described proDert? shall be usea on].v in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 4. That should any ~aragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the valid~t.v of this ordinance as a whole or any Dart or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corDoration violating any of the Urovisions or terms of this ordinance shs1] be subject to t}~e san~e penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shah be punished by fine not to exceed the sum of two hundred dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after {ts passage and oub]ieation of its caption, as the law in such cases provides.
