DEAR TARYON:
In response to your letter dated January 22, 1990 and as a result of our
subsequent conversation, I have revised the five stipulations that you addressed
as they pertain to the City Council approval of the subject tract.
CITY COUNCIL I~EQUESTHD STIPULATIONS FOR APPROVAL OF THIS ZONING
CASE:
1. ALL LOTS ALONG PECAN HOLLOW DRIVE BETWEEN .LODGE ROAD
AND HACKBERRY LANE SHALL BE A MINIMUM OF 85 ft. WIDE
AT THE MIDPOINT OF THE LOT DEPTH.
2. ALL PERIMETER TREES ALONG THE NORTHERN AND WESTERK
BOUNDARIES FROM 14 INCH DIAMETER AND ABOVE SHALL BE MARKED
AND SHOWN ON THE PRELIMINARY PLAT. THE DEVELOPER SHALL
5~KE HIS BEST EFFORT TO SAVE SAID TREES OUTSIDE OF THE
BUILDING PAD AREA. OF THOSE TREES THAT ARE DESTROYED,
THE DEVELOPER SHALL REPLACE WITH 2 - 3 INCH LIKE TREES
(OR BETTER) OF EQUAL QUANTITY.
3. HOMES IN AREA A SHALL BE A MINIMUM OF 2,000 SQUARE FEET,
AND ALL THOSE IN AREA B & C SHALL BE A MINIMUM OF 1,800
SQUARE FEET.

4. THE DEVELOPER SHALL IMPROVE LODGE ROAD AS FOLLOWS:
(a) CONSTRUCT THE WEST HALF (18.5 ft. wide pavement)
OF LODGE ROAD FROM PARKVIEW ADDITION TO THE SOUTH
LINE OF SHERWOOD PARK, SECTION TWO.
(b) CONSTRUCT THE ENTIRE PAVEMENT SECTION (37 ft. wide
pavement) FROM THE SOUTH LINE OF SHERWOOD PARK,
SECTION TWO, TO THE PROJECTION OF THE SOUTH LINE
OF SAID ZONING TRACT (approximately 300 ft. in
length) PROVIDED THAT THE DEVELOPER IS ABLE TO OBTAIN
THE NECESSARY RIGHT-OF-WAY FROM THE EBY TRACT.
IF THE DEVELOPER IS UNABLE TO OBTAIN THIS RIGHT-OF-WAY,
THEN THE WESTERN ONE-HALF OF LODGE ROAD (18.5 ft.)
BE CONSTRUCTED BY THE DEVELOPER TO THE AFOREMENTIONED
LIMITS. UPON DEVELOPMENT OF THE EBY TRACT, IT IS
UNDERSTOOD THAT THE DEVELOPER WILL BE REFUNDED ONE-HALF
OF THE COST FOR SAID IMPROVEMENTS IN ACCORDANCE WITH
THE SUBDIVISION ORDINANCE SECTION APPENDIX A (D-l.h).
5. THE DEVELOPER SHALL PROVIDE LANDSCAPING ALONG THE EAST
SIDE OF THE PROPOSED DEVELOPMENT ALONG THEIR FRONTAGE
OF LODGE ROAD.
Attached is a print of the revised site plan which addresses the specific
requirements of the Planned Development. If this is acceptable, I will
prepare three (3) reduced copies. Please let me know on or before Friday
January 26, 1990 so that I can respond accordingly.
