STAFF REPORT September 25, 1984
Mark W. Sweeney, Administrative Assistant
RE: Case #84-06-19 and 84-06-19.9/Tristar
Tompkins Joint Venture
LOCATION: Southeast corner of the intersection
of MacArthur Boulevard and Sandy Lake Rd.
REQUEST: Requesting rezoning of 6.07 acres of
MF-2 Multi-family-two to "C" Commercial
and 5.54 acres of "R" Retail to "C"
Comme rc i a 1
APPLI CANT: Tri sta r-Tompki ns Development represented
by Brian McDaniel of Lichliter-Jamison
and Associates.
GENERAL DESCRIPTION: The applicant is proposing to develop a 120,400 square
foot shopping center on an 11.6 acre site. The applicant's reason for the
zoning change is to consolidate with the adjacent property to more reasonably
establish a common use which would be compatible to surrounding development.
STAFF EVALUATION: The proposed zoning change is in conflict with the Future
Land Use Plan which calls for retail and Multi-family development. The
staff therefore recon~ends PD-R Planned Development - Retail, which includes
site plan review, as an alternate to "C" Commercial. "PD-R" zoning would
adhere to the Future Land Use Plan and would be more compatible with the
neighboring residential areas.
PLANNING A~Jl)~-Z-OJ~ING COHMISSION: The P & Z Commission recommended approval
(3-1) of ~L._"R_~L.~ Retail zoning classification, thus rejecting the proposed
"C°' Commerc~l zoning.
