APPLICANT: Thomas and Katherine McHale SURROUNDING LAND USE & ZONING: North - Vacant; (R) Retail, (SF-12) and (MF-2) Zoning South - Vacant; (SF-12) Zoning East - Vacant; (C) Commercial Zoning West - Vacant; (LI) Light Industrial TRANSPORTATION: A transportation study, performed by DeShazo, Starek and Tang, Inc., indicates that the R.O.W. width for Coppell Road should be 65 feet total (32.5 feet on each side). The applicant has agreed to satisfy this requirement, and it will be shown on the final plat. SUMMARY: On February 28, 1989, City Council tabled this item until the March 14, 1989 meeting, so the applicant could revise the zoning requested from (PD-SF-7) to (PD-SF-9). Applicant is requesting a zoning change from (R) Retail, to a planned development for (PD-SF-9) with a minimum lot size of 8,000 square feet. Dear Mayor Duggan: This letter comes to you from a concerned citizen who is beginning to wonder if he has any property rights left in the City of Coppell. On Tuesds~ night -February 28 - you and the City Council will take up our request to change zoning from RETAIL to SF 7 ~nd permit the development of Shadow Woods Estates. This case has drug on since October thru a series of at least three mistakes from Coppell City Hall f~ ling to ADVERTISE this project - ~nd apparently ORGANIZED opposition to development of this property. ~ wife Katharine and I bought this property in 1945 after I returned from ~verseas as an Air Force Combat Veteran ~nd a G~RMAN ~r~soner of ~ar for 14 months. We were good citizens and lived there for 25 years before moving to Dallas in 1970 We neveresked for RETAIL Zoning. Our property was first zoned multiple fmnily - and then changed arbitrarily to RETAIl. When City Hall and Coppell activity was moved to the other side of .Denton Drive Retail Zoning faded. We w ere assesed a~ the top of the m~rkaeta~d paid more~ than $ LO0,O00 in taxes in 1986-87 before getting a tax adjustment ona realistic basis. Now we are forced to zone ~&l our propety SF 7 in order to permit development. Realistically the only alternative is Single Family. M~ request to you is to give us SIMPLE JUSTICE. I want no favors because I am an ExPOW. Shadow Woods is in keeping with other developments in Coppell. I am 87 and ~y wife is in a similar age bracket. This property z~presents a substantial part of our life savings. Turning this down will amount to c onfi~tation of our property. We will be at the meeting. Thank You Minutes of January 19, PLANNING AND ZONING COMMISSION The Planning and ZOning Commission of the City~of-~Coppell met in pre-session at 7:00 p.m., and in regular session at 7:30 p.m., on Thursday, January 19, 1989, in the Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas 75019. The following members were present: Commissioner David Thomas Commissioner Robert Green Commissioner William Johnson Commissioner George Redford Chairman Munsch and Commissioners Tunnell and Weaver were absent. Also present were City Engineer Russell Doyle, Civil Engineer Shohre Daneshmand, Consulting Engineer Kevin Peiffer, and Administrative Secretary Linda Glidewell. Commissioner Johnson moved to appoint Commissioner Thomas as acting Chairman for tonight's meeting. Commissioner Green seconded the motion; motion carried (4-0) with Commissioners Green, Johnson, Redford and Thomas voting in favor of the motion. Commissioner Thomas called the meeting to order and everyone was asked to stand while Commissioner Green gave the invocation. Item 4: Approval of Minutes of December 15, 1988 Commissioner Johnson moved to approve the minutes of December 15, 1988 with the following correction: Item #8 should state ". . voting in favor", and Commissioners Redford, Thomas and Weaver voting against the motion". Commissioner Redford seconded the motion; motion carried (4-0) with Commissioners Green, Johnson, Redfordand Thomas voting in favor of the motion. PUBLIC HEARINGS Item 5: Public Hearing to consider approval of a zoning change, Case #ZC-516, from (R) Retail to (PD-SF-7), located 190 feet south of the southwest corner of Coppell Road and Sandy Lake Road, at the request of Thomas and Katherine McHale. City Engineer Russell Doyle introduced the item to the Commission. Mr. Doyle stated that this zoning case was approved by the Planning and Zoning C~ission at the December meeting. However, due to an error in the public notification, the City Council voted to remand this issue back to the Commission for their consideration. Chairman Thomas then opened the public hearing and asked for persons wishing to speak in opposition of the requested zoning change. Following discussion, Commissioner Redford moved to deny Case #ZC-516. Commissioner Thomas seconded the motion; motion failed due to a tie vote, with Commissioners Redford and Thomas voting in favor of the motion and Commissioners Green an~ Johnson voting a~ainst the motion. Commissioner Johnson the moved to approve Case #ZC-516 with the provision that the remaining portion of the property be rezoned to (PD-SF-7) by the owner prior to final platting of this property, and that the thirteen lots on the southern border of the property be restricted to houses with a minimum of 1800 square feet. Commissioner Green seconded the motion; motion carried (4-0) with Commissioners Green, Johnson, Redford and Thomas voting in favor of the motion. PLATTING .? Item 6: To consider approval of a preliminary Plat for Shadow Woods Estates Addition, located 190 feet south of the southwest corner of Coppell Road and Sandy Lake Road, at the request of Thomas and Katherine McHale. I appeared in front of Planning and Zoning when the tract at the corner of Tweed and Coppell Road was brought up for zoning and was changed from retail to SF-7 and a small strip of SF-12. The Planning and Zoning Commissioner, Bill Johnson, kept telling us that we were lucky to get the zoning out from retail. I do not think that this is pertinent. There is too much retail space present in Coppell already. The owner of the land is being overburdened by the taxes he is paying for retail and wants to get the zoning changed from retail to residential. Due to the quality of the neighborhood and due to the excess amount of water drainage that this would cause, I think this tract ought to be upgrade to SF-12. Sincerely, Melvin Gross, M.D. MG/CSI%139
