Dear Mr. Shaw:
In response to your letter regarding the responsibility for mowing
the alley right-of-way, I have met with staff and reviewed the
facts and circumstances surrounding this issue. As I promised you,
have asked our Public Works department to assume mowing
responsibilities for the time being while we resolve this question.
From my review of the plat, it appears that the area in question
was included in the plat which was approved by the City Council.
It is my understanding that it was this factor which led to the
Council committee's decision that the homeowners association should
maintain and mow this area. There is some confusion in the
interpretation of the current high grass and weeds ordinance. We
are therefore initiating an amendment to the ordinance which would
clarify its meaning. As soon as this amendment is prepared, I will
send a copy of it to you for your review and comment. It is my
suggestion that we meet and discuss this proposed amendment before
it is submitted to the Council. If we cannot come to some
agreement, you may then appear before the Council and present your
own views and recommendations.
If you have questions about the process that we have suggested,
please feel free to contact Acting Fire Chief Richard Terry or me
for explanation or clarification. We wish to express our
appreciation to you for your patience as we seek to find a solution
to this problem.
