Commissioner Johnson moved to approve PD-10S with the following
stipulations:
a) The developer has agreed to deed restrict aH lots in the development
in the following manner:
1) During the first three years, the minimum dwelling size
shaH be 1750 square feet.
7.) At the end of the three year period, if 50% of the lots
have not been developed, or 50% of the houses have not
been sold, the minimum dwelling size shaH be 1600 square
feet.
3) An}' builder may request a variance to build less than
1750 square feet during the first three years, upon the
approval of the Homeowners Association and the Board
of Adjustments.
Commissioner Green seconded the motion; motion carried (7-0) with Chairman
Munsch and Commissioners Green, Johnson, Pope, Thomas, T, mneH and Weaver
voting in favor of the motion.
CITY MANAGER'S COMMENTS/RECOMMENDATION FOR AGENDA ITEM
I. Item # 6 CITY COUNCIL AGENDA DATED: January 12, 1988
II. COMMENTS/RECOMMENDATION:
In the original request, the applicant was requesting approval of
minimum lot size of 7600 square feet and the plan presented before you
is a minimum lot size of 8500 square feet. The Meadows Homeowners
Association is happy with this revision and have shown their support.
If the City Council decides to approve this zoning change, a proper
motion would be to approve the zoning change noting that the developer
has voluntarily agreed to deed restrict all lots in the development in
the following manner:
1. During the first three years, the minimum dwelling size shall
be 1,750 square feet.
2. At the end of the three year period, if 50% of the lots have
not been developed, or 50% of the houses have not been sold,
the minimum dwelling size shall be 1600 square feet.
*3. Any builder may request a variance to build less than 1750
square feet during the first three years, upon the approval of
the Homeowners Association and the Board of Adjustments.

*Note: City Attorney Larry Jackson has suggested the following wording
for condition number 3:
During the first three year period a builder may apply to the
Homeowners Association to construct less than 1,750 square
feet. If such request is first approved by the Homeowners
Association and the Coppell Board of Adjustments, such builder
may build in accordance with such approval without being in
violation of the minimum 1,750 square foot condition of this
deed restriction. The Coppell Board of Adjustments will not
be requested to consider such matters until after an applicant
has obtained approval by the Homeowners Association.
