C. HEARING DATE: February 12, 1991 LOCATION: 741Woodmoor Drive; Lot 20, Block A, Meadows Addition, Section 6. SIZE OF AREA: Approximately 9400 square feet. REQUEST: Applicant is requesting to be allowed to construct a 1 1/2 story structure. This development is limited by a note on the face of the subdivision plat to one story structures only. APPLICANT: Robert G. Delsanter Greystone Custom Homes 16610 Dallas Parkway, Suite 2000 Dallas, Texas 75248 (214) 931-1756 HISTORY: There has been no recent zoning history on the parcel in question, nor in the immediate subdivision (commonly referred to as "The Woods"). PD-105 was granted for residential uses some years ago. TR~SPORTATION: Woodmoor Drive is a local, residential street contained within a 50 foot right-of-way. Samuel Boulevard is a two-lane undivided, built to standard thoroughfare with 60-65 feet of right-of-way. SURROUNDING LAND USE & ZONING: North - residential; PD SF-9 South - residential; SF-9 East - residential; PD SF-9 West - residential; PD SF-9 COMPREHENSIVE PLAN: The Comprehensive Plan indicates single-family detached residential land use is appropriate here. ANALYSIS: At first blush, this seems like a rather strai§ht-forward, non-controversial issue. On closer observation, however, history of the grantin§ of the original PD-105 reflects that the height of buildings on 3 lots generated a substantial amount of neighborhood concern. When the original PD was granted, a note was place on the face of the development plan limiting height of buildings on lots 18, 19 and 20. Those lots were restricted to one story residences. It is staff understanding that this point was discussed, in part, due to concerns of property owners who live south of the common alley (runs parallel to Woodmoor) and separates The Woods development from existing one story homes° The possible invasion of privacy due to two story structures looking into the backyards of the existing one story houses on Lansdowne Circle was cited as a reason for neighborhood concern. At any rate, a very specific note was placed on the PD development plat which read: "Lots 18, 19 and 20, Block A, are limited to one (1) story and a 6' high fence along the alley unless the grade difference between the rear foundation elevations of the said lots and existing lots 15, 16 and 17, Block A is reduced to two feet above top of curb for its respective lot." Because of this note, it was determined that a public hearing would be necessary to alter that wording, hence the request before you this evening. From a technical and aesthetic perspective, staff has no objection to the proposed revision for lot 20. However, because of the history of this zoning case, the fact that the existing households along Lansdowne requested the specific height limitation, and the PD was in place with this condition before the applicant purchased this lot, we would reserve making a recommendation until the public hearing. If no objection surfaces on January 17, staff would recommend approval of the PD amendment; if strong, rational resistance is present, we would recommend leaving the height condition as ori§inally stated. Councilman Thomas seconded the motion. The motion carded 6-0, with Mayor Pro Tern Smothermon and Councilmen Weaver, Thomas, Cowman, Robertson and Nelson voting in favor of the motion. Item 14 Discussion and consideration of supporting and participating in the proposed IH35E Corridor Task Force. City Manager Alan D. Ratliff made the presentation to Council. Councilman Robertson moved to support verbally the IH35E Corridor Task Force and encourage them to proceed with the improvements. Mayor Pro Tem Smothermon seconded the motion. The motion carded 6-0, with Mayor Pro Tern Smothermon and Councilmen Weaver, Thomas, Cowman, Robertson and Nelson voting in favor of the motion. Item 15 Discussion and consideration of establishing a recommendation for establishing boundaries of air quality nonattainment area. City Manager Alan D. Ratliff made the presentation. He referred to a letter from the Council of Governments asking for review and comment regarding Boundaries of Air Quality Nonattainment Area. Following discussion of this item, Councilman Robertson moved to approve Option 1 - Entire CMSA (9-county-area) under common Marginal classification as presented for the nonattainment area. Mayor Pro Tem Smothermon seconded the motion. The motion carded 6-0, with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Cowman, Robertson and Nelson voting in favor of the motion. Item 16 Discussion and consideration of approving the employment of a facilitator for the City Council/Staff retreat to be held on March 16, 1991, and authorizing the City Manager to execute a contract for said services. City Manager Alan D. Ratliff made the presentation to Council. Councilman Cowman moved to approve the employment of Chris Hartung as the facilitator for the City Council Staff retreat scheduled for March 16, 1991 at a cost not to exceed $950. Councilman Thomas seconded the motion. The motion carried 5-1, with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Cowman, Robertson and voting in favor of the motion and Councilman Nelson voting in opposition to the motion. Item 17 PUBLIC HEARING: To consider an amendment to zoning designation PD-105, commonly referred to as Lot 20, Block A, at 741 Woodmoor Drive, to allow the construction of a 1 1/2 story house with roof line not to exceed 31 feet above grade. Planning and Community Services Director Gary Sieb made the presentation. The Planning & Zoning Commission did r~ommend approval to the PD with a vote of 5-2. Robert Delsanter of Greystone Homes was also present to state his case for changing the zoning designation of Lot 20 and answer questions of the Council. Mayor Wolfe opened the Public Heating and asked if there was anyone who wished to speak in opposition of the zoning change. Paul Williams of 137 West Lansdowne Circle came forward to voice his concern that any building taller than a single story would destroy the privacy of his back yard. He asked that the change be denied. Mayor Wolfe asked if there were any citizens who wished to speak in favor of this request. There were none who wished to speak. Mayor Wolfe closed the Public Hearing.
