WHEREAS, the City Zoning Commission and the Governing Body of the City of Coppell, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes, and pursuant to the zoning ordinance and zoning map of the city of Coppell, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that said change of zoning, which is on application of Heath & Knight, No. PD-lZl, should be granted and the Comprehensive Zoning Ordinance of the city of Coppell should be amended in the exercise of its legislative discretion. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. city of Coppell, Texas, amending the Zoning Map property hereinafter classification, to wit: That the Comprehensive Zoning Ordinance of the be and the same is hereby amended by of the city of Coppell, to give the described, a new zoning district "PD-SF-7" Planned Development District Classification governed by the Development Plan attached hereto as Exhibit 1 and the Regulations attached hereto as Exhibit 2. Except as otherwise provided on Exhibit 1 or in the regulations set out in Exhibit 2, the property shall be governed by the regulations of the SF-7 District Regulations. Said property being described as follows: BEING two tracts of land with Tract 1 containing 14.928 acres, more or less and Tract 2 containing 14.467 acres, said tracts being described by metes and bounds in Exhibit "A" attached hereto and made a part hereof and shown on the site Plan attached hereto as Exhibit "1" and made a part hereof. SECTION 2. That all parts of any ordinance of the city of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances or parts of ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the city of Coppell, as amended herein by the granting of this zoning classification. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the city. Any use permitted in the 'SF-ED', 'SF-18", 'SF-12" or the 'SF-9" district. 2. Home Occupation. 3. Such uses as may be permitted under the provisions of special use permits in the Sections 30-5 and 30-6. Thirty-five (35) feet nor more than two (2) Maximum Height Regulations: stories high. Councilman Morton requested and received consensus of Council regarding a $1,000 expense for dividends for the Economic Development Board. This item will appear on the consent agenda at the next Council meeting for formal approval. Item 21 Liaison Reports YMCA Councilman Robertson stated there were 135-150 people who attended the YMCA grand opening, and that they are already looking at expansion. METROCREST RED RIBBON CAMPAIGN COMMITTEE Mayor Pro Tem Smothermon reported the Red Ribbon Committee met, and the Red Ribbon Campaign will start October 19, 1992 and is being carried by other cities' police departments (Addison, Carrollton, Farmer's Branch). He stated the Farmer's Branch Police Department had a softball team, and he would like Coppell's police officers to take a more active part in this campaign. He also reported there is another meeting scheduled for August 12, 1992. PARK Councilman Thomas reported the Park Board is looking at a creative playground, and it was the consensus of Council to bring this subject forward next time. CONSENT AGENDA ~Item 20 A. Following discussion, Councilman Nelson moved to approve a final plat (secondary plat) for Sandy Lake Addition, Lot 1, Block B, located along the west side of Samuel Blvd., 335 feet north of Sandy Lake Road at the request of Dr. Stephen King. Mayor Pro Tem Smotherman seconded the motion. The motion carried 6-0, with Mayor Pro Tern Smothermon and Councilmen Weaver, Thomas, Morton, Robertson, and Nelson voting in favor of the motion. Item 26 PUBLIC HEARING: Consideration and approval of a zoning change for Case #PD-121, (Gibbs Station Addition, Phase I), from MF-2 to PD-SF-7, located along the east side of MacArthur Blvd., and North of Parkway Blvd., at the request of Heath & Knight Properties. Planning and Community Services Director Gary Sieb made a presentation providing information about the development. Hammond Heath of Heath and Knight properties made a presentation further explaining the subdivision. Mayor Wolfe declared the Public Hearing open and asked if there were any persons who wished to speak in favor of or in opposition to the plan and fees. Rick Earl of 607 Allen Road on behalf of the homeowners association spoke in favor of the proposal. There being no other persons who wished to speak, Mayor Wolfe declared the Public Hearing closed. Discussion followed. Councilman Morton moved to approve zoning case change for Case #PD-121, (Gibbs Station Addition, Phase I), from MF-2 to PD-SF-7, located along the east side of MacArthur Blvd., and North of Parkway Blvd., at the request of Heath & Knight Properties with the following four conditions: 1) Front lots be allowed on Village Parkway which is a collector street, 2) Gibbs Crossing between blocks A and B south of Village Parkway be allowed to have a length of +/- 1600 feet, 3) lots 15-19, Block A are approved without alleys in the rear, lots 1-42 in Block E are approved without alleys in the rear, and 4) prospective buyers be provided a single page 8-1/2 x 11" sheet disclosing the existence of the Lakes of Coppell Homeowners Association indicating the tax rate at the time and this be provided to them at the time the earnest money contract on the home is executed. Mayor Pro Tem Smothermon seconded the motion. The motion carried 6-0, with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Morton, Robertson, and Nelson voting in favor of the motion.
