Dear Gary:
An issue between the Developer and the property Owner has arisen.
As you are probably aware, the subject property needs to be annexed
into the C.M.U.D. prior to development. The C.M.U.D. requires that
the developer make application for annexation. The current
property Owner, Ms. Barbara Austin has chosen not to formally
extend a contract to Mr. George Gibson, however they are currently
discussing the project. The Developer does not feel comfortable in
closing on the property prior to acknowledgement by the C.M.U.D.
that the project can be provided sanitary sewer.
Ms. Austin has basically told the Developer that they should close
on the property regardless of this confirmation and that there is
a possibility that she will work with another Developer.
The purpose for letter is not to discuss the details of the
transaction but to request that no information that we prepared be
distributed to anyone except as required by law.
There is an outstanding financial liability on these documents,
which is due to us.
I respectfully request this of you and the City Staff. Thank you
for your assistance in this matter.
