PD130-CS 970109TO: Greg Jones, Building Official Pert Virtanen, Assistant Director of Planning and Community Services,¥~/',~/ FROM: SUBJECT: Austin Place Sideyard Requirements DATE: January 9, 1997 Randy Lockhart, with Standard Pacific, requested that the Planning Department review the file for PD-130 to determine what sideyard requirement Council approved. This was a controversial case involving several revisions, but after sorting through the file material we have concluded that Council approved 6' sideyards. This is based on a submission document entitled Planned Development Exhibit which-listed-azea regulations in the upper right comer. Under *Minimum ..... Size of Yards" the area regulations stipulated a 6' sideyard. We believe that this is the site plan which Council approved. When the ordinance passed, we believe that the Planning and Zoning Coordinator inadvertently attached a copy of the Preliminary Plat, instead of the Planned Development Exhibit, as Exhibit 2. This would explain the language of the ordinance where it reads: "Except as herein stated or otherwise provided on Exhibit 2, the property shall be governed by the regulations of the SF-7 District Regulations attached hereto as Exhibit 1."
