Dear Ms. Blackwood:
Your wish to expedite and our legal constraints are, to say the least, incompatible. Even had
it been the proper avenue of relief, your initial application to the Board of Adjustment would
not have resulted in a hearing before June. I have that application in hand, and it will serve as
an application for a site plan revision, which in a planned development district is the proper
avenue for seeking approval of the carport you want to build. Because of the notification
requirements prescribed by state law, however, I cannot get your request to the Planning and
Zoning Commission for its recommendation until June 20. Furthermore, City Council cannot
consider that recommendation until July 9, at the earliest. The state legislature, in granting
cities authority to enact zoning regulations, deliberately made it difficult to change them.
Knowing the position of the Woodridge Homeowners Association president and board of
directors, I feel that I would be remiss if I encouraged you to believe that the City Council or
the Planning and Zoning Commission would ignore the opinion of a neighborhood organization.
Both bodies may, if fact, agree with you, but they may also side with what they perceive to be
the viewpoint of the majority. Very soon the association will be putting out a newsletter which
will contain an article about garages and carports. The newsletter includes my phone number,
so that residents can call me with suggestions. If there should be a groundswell in favor of
permitting detached carports, I will certainly pass that information along to Mr. Daniels.
Also, I talked with the head of our Finance Department. She said there will be no problem in
transferring the $100 application fee from the Building Inspection Department to the Planning
Department. So, unless a clerk inadvertently sends you a refund, you will not have to go to the
trouble of depositing one check and writing another. If for any reason, however, you decide
not to proceed with your request, call me by May 31 (before we send out notices) and I will
have the refund processed.
