Dear Ms. Kertz:
Thank you for commenting on the matter of variances. And, of course, you are absolutely right.
It is interesting to note that prior to this year's undertaking to reclassify SF-0 districts, there
were a total of 36 PD districts scattered throughout the city. Two are located in your
neighborhood, one just north of Minyard Drive and another just east of Winding Hollow Lane.
To my knowledge the lack of an avenue of appeal to the Board of Adjustment has not created
any significant problems.
The comparable procedure available within PD districts is a site plan amendment. Since site
plan amendments are not subject to the stringent justification requirements for a variance, this
avenue is actually more favorable to you and your neighbors. Consequently, in changing from
an SF-0 district to a PD district, I do not believe that you will lose anything of major
importance.
For example, assume that an individual might want to expand a residence slightly into a required
yard and that the neighbors have no objection. To qualify for a variance to be granted by the
Board of Adjustment, that individual would have to show that a condition applicable only to that
lot, and not to any others, had created the circumstances. Such circumstances might be an
irregular shape of the lot or unusual topography. As you well know, requests for variances are
far more likely to arise out of desire or preference than out of hardship created by atypical land
configuration.

In approving a site plan amendment, City Council would not be subject to these limitations. The
Council could exercise simple judgment and discretion.
At this point you may be wondering why, then, do we have a Board of Adjustment. The Board
of Adjustment is very important, because the majority of the City does not and should "not have
the flexibility of PD district regulations. The Board is very much needed to make those difficult
determinations which, if not made, might deprive property owners of reasonable use of their
land.
Again, thank you for your commentary. It will help us be better prepared for answering
questions at the public hearing.
