Case ~ZC-SZ4 was first submitted to the Planning and Zoning Commission on February 15, 19905 however, the Commission tabled the zoning change request until the March 15th meeting in ca'der to review decisions made by a-joint session of the City Council and the Historical Committee. SIZE OF AREA: 5.4 acres APPLICANT: Mrs. Julianna Otts HISTORY: There has been no recent zoning activity on this parcel. The tract to the north and east {approximately 20 acres) was considered for rezoning to residential use. The acception of the amending ordinance is, however, tied to plat approval not yet accomplished. At the Planning Con~nission meeting on February 15, 1990, the Commission tabled the zoning case until the next meeting in order to review decisions made by a joint session of the Historical Ccm~ittee and the City Council. T.~SPORTATiON: Bethel Road is classified as a six-lane divided thoroughfare; today it is a :wo-!ane street. In addition to complying with the future land use plan. this request will allow the property owner to legally utilize the property for a use not permitted in (R) Retail zoning - the keeping and maintaining of horses. This tract had been used for boarding horses by the land owner for years. Approximately a year and one-half ago, the owner moved away, took her horses with her, and technically lost non-conforming status in this (R) zoning district. After considerable difficulty in leasing her former home, the applicant finally rented the property last winter with the understanding That the lessee could board a horse. Shortly after the renter moved in, a warning was issued stating that the keeping of horses was not allowed in (R) districts. The City has cooperated with the land owner as she goes through the re-zoning process, and has agreed to wait until the outcome of this case before pursuing more aggressive compliance with our zoning laws. If the zoning is granted, of course, a zoning violation will no longer be present on the subject tract and this land owner will: 1) comply with the comprehensive land use plan; and 2) be allowed to continue a use on her property which had been long standing. In addition, the applicants request suggested realignment of Cotton Road, eliminating Southwestern, both west of Freeport Parkway. Staff has no objections to the realignment/deletion request. Mr. Sieb further stated that the Focus Group is studying all the thoroughfares west of Denton Tap Road. He then stated that K.R. Marshall of Barton-Aschman was at the meeting to answer any technical questions. In closing, Mr. Sieb stated that the outcome of this amendment will directly affect two of the plats to be considered later on the agenda. Civil Engineer Shohre Daneshmand stated that the Public Works Department is recommending the four-lane divided thoroughfare. Mr. K.R. Marshall of Barton-Aschman was present to represent this item before the Commission. Mr. Marshall started that they basically did a more detailed technical analysis of the traffic in the area, and have determined that a six-lane thoroughfare is not necessary in this area. Following discussion Commissioner Gross moved to amend the Thoroughfare Plan per the applicants request, and from a six-lane divided thoroughfare to a four-lane divided thoroughfare. Commissioner Tunnell seconded the motion; motion carried (4-2) with Chairman Munsch and Commissioners Gross, Redford and Tunnell voting in favor of the motion, and Commissioners Green and Scott voting against the motion. PUBLIC HEARINGS Item 6: Consider a zoning change, Case #ZC-524, from (R) Retail to (SF-9) Single Family-9, located at 316 W. Bethel Road, at the request of Julianna Otts. P&Z Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated that at the last Planning and Zoning meeting the Commission informed Mrs. Otts it would not be necessary for her to attend this meeting. She stated that this zoning change is being requested in order to allow the boarding of horses on the property. Ms. Bowman then stated that the Historic Committee had met, and this request does fit in with their intentions for the area. Chairman Munsch opened the public hearing and asked for persons wishing to speak in opposition to this request. There were none. He then asked for persons wishing to speak in favor of the request. Again there were none. The public hearing was then declared closed. Commissioner Gross seconded the motion; motion carried (6-0) with Chairman Munsch and Commissioners Green, Gross, Redford, Scott and Tunnell voting in favor of the motion. PLATTING Item 7: Consider approval of a final plat for Meadows Addition, Section 6, Phase 2, located at the southeast corner of Parkway Boulevard and Samuel Boulevard, at the request of Meadowglen Properties. P&Z Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated this plat is actually Phase 2 of the Meadows Addition, or Case #PD-105. If approved, this plat will allow the construction of thirteen single-family structures on 2.68 acres. She further stated that all DRC comments have been addressed; therefore, staff has no objections to the plat. Mr. Glen Hinckley was present to represent this item before the Commission. He stated that all utilities are already in place, and that this property should have been included with the final plat with D.R. Horton's project directly adjacent to this property. Mr. Hinckley stated that it was due to an oversight that this property was not included. Following discussion Commissioner Tunnell moved to approve the final plat for the Meadows Addition, Section 6, Phase 2. Commissioner Scott seconded the motion; motion carried (6-0) with Chairman Munsch and Commissioners Green, Gross, Redford, Scott and Tunnell voting in favor of the motion. Item 8: Consider approval of a final plat for Park West Commerce Center Addition (formerly Gateway Park @ Coppell), located at the southwest corner of Southwestern Drive and Beltline Road, at the request of Prentis/Copley Properties. Director of Planning Gary L. $ieb introduced the item to the Commission. Mr. Sieb stated that this is a 328 acre tract, with the preliminary plat already approved. He also stated that staff would recommend approval of this final plat, however, he would like to point out that the Public Works Department has several concerns, as outlined in their memo dated March 14, 1990.
