Staff Report - 2/15/90 CITY OF COPPELL PLANNING DEPARTMENT STAFF REPORT CASE #: ZC-524 HEARING DATE: February 15, 1990 LOCATION: 316 W. Bethel Road REQUEST: Consideration of a zoning change from (R) Retail, to (SF-9) Single Family-9. SIZE OF AREA: 5.4 acres APPLICANT: Mrs. Julianna Otts HISTORY: There has been no recent zoning activity on this parcel. The tract to the north and east (approximately 20 acres) was considered for rezoning to residential use; the acception of the amending ordinance is; however, tied to plat approval not yet accomplished. TRANSPORTATION: Bethel Road is classified as a six-lane divided thoroughfare; today it is a two-lane street. SURROUNDING LAND USE & ZONING: North - Single family structures; (R) & (SF) zoning East - Single family structures; (R) zoning South - Vacant; (R) & (C) zoning West - Vacant: (R) zoning COMPREHENSIVE PLAN: Projected for single-family residential uses. ANALYSIS: In that the request for zoning change complies with the comprehensive land use plan, staff has no objection to this proposal. In addition to complying with the future land use plan, this request will allow the property owner to legally utilize the property for a use not permitted in (R) Retail zoning - the keeping and maintaining of horses. This tract had been used for horses by the land owner for years. Approximately twenty months ago, the owner moved away, took her horses with her, and technically lost non-conforming status in (R) zoning districts. After considerable difficulty in leasing her former home, the I T E M 5 applicant finally rented the property last winter with the understanding that the lessee could board a horse. Shortly after the renter moved in, a warning was issued stating that the keeping of horses was not allowed in (R) districts. The City has cooperated with the land owner as she goes through the re-zoning process, and has agreed to wait until the outcome of this case before pursuing more aggressive compliance with our zoning laws. If the zoning is granted, of course, a zoning violation will no longer be present on the subject tract and this land owner will: 1) comply with the comprehensive land use plan; and 2) be allowed to continue a use on her property which had been long standing.
