PUBLIC HEARING:
Public Hearing to consider approval ora variance request fi.om the fence requirements of
Ordinance No. 91500-A-157, as amended for the Planned Development No. 159, for the
property located at $15 Westminster Way. Ms. Karen Farnum is requesting a 1
variance to the sideyard setback, for this PD-zoned district, to allow for the relocation of
the fence to the property line on the south side of the lot.
EXPLANATION:
The Planned Development (I'D) subdivision plat, approved for Asbury Manor by
Ordinance #91500-A-157, specifically calls for a sideyard setback for building
construction and fences at 15 feet fi.om the street right-of-way. The house in question
was constructed at that 15-i~. setback with an open rear patio area at the somhwest comer.
Unfortunately, because this floor plan has the patio area at the rear southwest corner,
when the fence was permitted for construction, holding the required fence setback caused
the fence construction to effectively close off one open side of the patio to the south, as
the enclosed photographs indicate.
The applicant is requesting a variance to allow for the fence to be moved a total of 15 feet
to the southern property line to allow for a larger useable rear yard area and open up the
patio.

STAFF RECOMMENDATION:
In this case, as well as the case involving 516 Cromwell Court, the problem has been
created by a poor selection of house design to the lot.
Approval of a full 15-i~. variance will result in visual narrowing of the street since the
moving of fences will directly result in an immediate visual impact to the street
appearance along Westminster Way.
Staffwould recommend the Board consider this impact and minimize the effect by
considering approval of a reduced variance to both lots.
