Dear Mr. Hardin:
Staff calculated the area within 200 feet of the referenced zoning case to be 933,700 square feet.
Following the Planning and Zoning Commission meeting, we matched the signatures on your
petition to the ownerships shown on the City's tax records. For each match we calculated the
area of that owner's property within 200 feet of the property requested for rezoning. At that
time, the property we knew to be owned by those who signed the petition or sent in written
opposition by other means accounted for 21% of the area within 200 feet.
Prior to the City Council meeting, owners of three properties withdrew opposition. Each
property accounted for approximately 1% of the total area within 200 feet, thereby reducing the
amount of land represented by owners in opposition to approximately 18%.
It is possible that some of the signers of your petition could be recent purchasers of property,
whose names are not yet listed on the City's tax records. They also could be renters. We have
no way of knowing which. If you can prove that the signers of your petition, combined with the
written opposition of Mrs. Ramsey, represent at least 186,740 square feet within 200 feet of the
property to be rezoned, the number of Council votes in favor of the rezoning would be
insufficient to bring about its passage.
