PD166-CS 980701TO: Bob Hager, City Attorney FROM: Pert Virtanen, Assistant Director of Planning and Community Services ~ SUBJECT: Westbury Manor Opposition Petition DATE: July 1, 1998 Aider a meeting with Jim Witt this morning, in which Gary and I briefed him on how we calculated the amount of written opposition to Westbury Manor, Jim said that he would get in touch with you. The purpose of this memo is to provide you with background information. Prior to the Planning Commission meeting, the Planning Department received a petition signed by residents in opposition to the Westbury Manor zoning case. We also received one reply to our letter of notification to each owner, as indicated by the most recently approved tax roll, of real property within 200 feet. This was sent by Hazel Ramsey. After the Planning Commission meeting I reviewed the petition and our response forms, and calculated land areas. I compared the petition with our notification list. Where the tax roll indicated that a signer was a property owner, I counted that property. In several cases, the tax roll indicated joint ownership, but I counted the property even when only one of the two parties had signed. The results showed that 21% of the property within 200 feet was represented by owners, as shown on the tax roll, who had signed in opposition. Prior to the City Council meeting, one of the applicants obtained the signatures of four people, representing three properties within 200 feet, withdrawing their opposition. This reduced the opposition land to about 18%. However, in the case of one property, representing a little over 1% of the total area, both joint owners signed in opposition and only one withdrew it. Some of the neighborhood residents are challenging our methods. We feel that we have been generous in accepting one signature as representing a joint ownership in opposition. Having done that, we feel justified in accepting one signature as representing a joint ownership withdrawing opposition. You might want to check case law to see if there have been any rulings on establishing ownership. While a city is required to notify based on the tax roll, the statute requiring a 3/,~ vote of Council simply says "the protest must be written and signed by the owners of at least 20 percent of" the land within 200 feet.
