Dear Mayor Sheehan:
The pu~ose of this leffer is to address and propose a potential ~mpromise on
the Westbu~ Manor development plan to alleviate a ~ntinuing ~n~rn of the
adja~nt prope~ o~ers to the east.
I have had dis~ssions with Mr. Byron Hardin, ~o I believe has spoken on
numerous ~sions with Staff and Council r~arding our new neighbo~ood,
and as a representative for his neighbors. The main issue ~ntinues to be their
desire that we not use the alley be~een the ~o neighbo~oods. Staff, Planning
and Zoning and Council has ~nsistently op~sed this request, desiring Ryland
to build homes with rear garages on London Way.
The ~mpromise I would offer would be that Ryland not build alley se~ed homes
on lots 1~ of BIo~ I, the area of the trees. This would redu~ by half the
number of new ~rs potentially using the alley, as well as allowing the greatest
potential savings of desirable trees in an area that would most affect the
adja~nt homeowners. The arborist we have hired to ~nsult on this site, (at the
City's request,) will re~mmend this approach in their repo~ to us. The
a~ss points off the alley be~een lots 1-2 and lots 12-13 on London Way
would still be ~nstructed.
I have had fu~her discussions with Ga~ Sieb regarding this, and he has been
~ndid that this idea is still not popular with City Officials, but may be a
~mpromise that the City and Ryland could offer to the adjacent homeowners as
a showing of ~operation.
We are prepared to build the new homes in either garage Io~tion, to the City's
wishes.

The issue of replatting the alley, per Mr. Hardin, is not a pressing issue. Without
100% consensus, we would be unable to accomplish this. We remain willing to
undertake this if circumstances change.
The homeowners have requested a clarification from the City Attorney on the
liability issue in the alley, since the easement is on their property. It is my
understanding that this has not yet been received.
I am available to discuss these issues at your convenience.
