HISTORY: No recent zoning history on the parcel of land, although an earlier
application (originally to be heard on May 20) on 4 acres with 11
lots was postponed by the applicant to allow assembly of this larger
acreage.
TRANSPORTATION: DeForest Road is a local street contained within a 50-foot r.o.w.
SURROUNDING LAND USE & ZONING:

COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for
flood plain until/unless removed from the flood plain.

DISCUSSION: This is a request to zone land PD SF-12 on an approximate 8.4 acre tract
currently zoned "A" Agriculture. The request calls for 17 lots, each
containing at least 12,000 square feet. The density requested is compatible
with surrounding zoning and lot size is, in fact, much larger that the lots
on the south side of Deforest Road. This land use is identical to uses in
close proximity, and from that perspective is supportable by staff.
Included is a landscape plan which meets the standards outlined in the
zoning ordinance. There is no screening wall proposed here, and the PD
is being requested primarily to eliminate the alley requirement. Some
attention (by the applicant) needs to be directed to the tree mitigation plan
and the specific comments of Leisure Services (attached). Also, our
maximum cul-de-sac length is 600 feet, and this proposal exceeds that limit
slightly. The Planning Commission can recommend a length greater than
600 feet to the Council, but it is the responsibility of the applicant to
justify it. Several additional pieces of information need to be added to the
plans as conditions. See the staff recommendations section of this report
for specifics relative to this comment.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
The planning staff recommends approval of this request subject to the following
conditions:
1. Justification of cul-de-sac length greater than 600 feet
2. Show dimensions of all lots on all exhibits
3. List all PD conditions on plans including: "landscaping
shall be as shown on landscaping plan approved with
this proposal"
4. Need side and rear yard setbacks (20 feet and 8 feet
respectively) and state on all exhibits
5. Departmental comments are addressed (Fire and Leisure
Services)
6. The $1285 per lot park land dedication fee is paid
7. Provide a notation on all exhibits that lots iX, 19X, and
20X are common areas to be maintained by an HOA

The Tree Survey shows that development is removing 124" of protected trees from the
site. Development is preserving 123" of trees, allowing a preservation credit of 100%.
A number of the trees located on the northern portion of the site seem to be in an area
where extensive fill will be required to bring the site out of the flood plain. The
preservation techniques used on such trees will be closely monitored and additional
mitigation may be required if it is determined these trees have little chance of survival
after development.
Please provide an executed Tree Removal Permit prior to removing trees from the site.
The developer should be aware that the Park Development Ordinance is in affect for
this development requiring park dedication or $1,285.00 per dwelling unit in lieu
thereof.
