Box 478 Coppell, Texas 75019 214-462-0022 Mr. Dennis Winzeler Vista Properties 5950 Berkshire Lane, Suite 400 Dallas, TX 75225 RE: PD-149, Vistas of Coppell Dear Dennis: Regarding Case No. PD-149, Vistas of Coppell, the Coppell City Council approved at its May 14, 1996, meeting, the zoning change on Tracts I and II from HC (Highway Commercial) and MF-2 (Multi-Family-2) to PD-SF-7 (Planned Development, Single Family-7) on the south side of the 121 Bypass and denied your request to rezone Tract V from HC (Highway Commercial) to PD-MF-2 (Planned Development, Multi-Family-2) on the property east of Denton Tap Road and north of the 121 Bypass. The following conditions apply to the PD-SF-7 zoning change: 1) 2) 3) 4) 5) Increase the building setback 35' from the landscape easement along SH 121, for a total of a 50' buffer, which includes a 6' screening wall on top of a 3' berm; the minimum setbacks shall be varied; i.e., 20, 22 1/2, or 25 feet from the front property line; with no fewer than 25 % of the total number of homes in any one of these positions; fencing of side yards adjacent to proposed streets need to adhere to the 15' setback requirement; all residences adjacent to freeway right-of-way shall be a maximum of one story in height, and compliance with Engineering comments (copy attached). Because you raised the issue of whether dedicated open space was approved by Council in this PD -- staff had recommended no dedication, the applicant had submitted plans which showed dedication -- I reviewed the audio tapes of the meeting. As you recall, staff feels the linear dedication adjacent to the Lone Star Gas line is not well-suited for usable park land. Unfortunately, the tapes do not offer any clear-cut resolution to your concern. Therefore, I would recommend that you prepare your revised Ordinance exhibits as you believe City Council passed your zoning case. If the exhibits do not reflect our understanding of the Council action, we will ask for clarification prior to Ordinance adoption. As you know, in order to prepare an Ordinance, we need to assemble appropriate documentation. Please submit your revisions to us as soon as possible. Traffic signals may need to be provided to allow vehicles to exit the subdivisions. In addition, a traffic impact analysis should be provided to determine the impact on Denton Tap and MacArthur Blvd. by these developments to determine if mitigation measures are required. (Note: A traffic study has been provided and is currently being evaluated.) Phase I Information should be provided on the flood protection provided by the levee. The Coppell Floodplain Ordinance requires that the height of the levee be based on the standard project flood elevation, plus 3 feet of freeboard. Any access to the state highway will also require TxDOT approval. Phase H Preliminary Comments: 1. Permission will be required from Lone Star Gas to extend the street over their easement. 2.
