Dear Mr. Hinckley,
I am in receipt of your January 26th faxed letter suggesting the landscaping along the north side of
Town Center Boulevard will be completed by the Children's Courtyard. We have three concerns
which were not addressed by your correspondence:
1)
The zoning ordinance which granted the use of your property (to which you refer
as Lot 1 ) specifically stated that development of Lot 1 would ensure the land-
scaping of the north side of Town Center Boulevard (referred to as Landscape
area "A"). Such landscaping is normally in place prior to a Certificate of Occu-
pancy being granted. As we are aware, landscaping has not even started in that
area, and some landscape activity must occur before the City will sign-off on a
C.O.
2)
An "estimated" August 2001 finish date for landscaping this area is unacceptable
to the City.
3)
Your letter states the Children's Courtyard is responsible for this landscaping
(the Ordinance, referred to above, clearly states is the responsibility of Lot 1). A
signed agreement by the Courtyard will be necessary before we further consider
your request.
As indicated in our conversation of last Friday, your request for a C.O. for Lot I is highly unusual
without total compliance with the zoning granted. Once we have assurance that the landscaping
along Town Center Boulevard is underway, we have a more reasonable completion date and
written assurance that "someone" is responsible for completing/maintaining it, we will reconsider
your request for a C.O.
