BOX 478 October 8, 1997 Dr. Greg Weber All Care Veterinary Hospital 353 North Denton Tap Road Coppell TX 75019 re: Vehicular Landscape Buffers Dear Greg: You have expressed concern about the manner in which perimeter landscape buffers will. be measured relative to an area of open drainage at the northwest corner of your property on Denton Tap Road. The zoning ordinance requires that any vehicular pavement be set back from the property line. Adjacent to a street right-of-way the minimum setback distance is 15 feet. For all other property lines, the setback distance is 10 feet. It makes no difference where the property line is. I can be on top of a hill or at the bottom of a ditch. We simply measure a horizontal distance from the property line. In addition to the setback, the ordinance requires a low screen within the setback. This can be accomplished with a fence or wall at least 3 feet high, with a berm, or with landscape material that will grow 3 feet high. This is measured from the ground up, wherever the screening is placed. In your case, the presence of 10 feet of drainage easement along the western edge of your property, and the presence of open drainage anywhere within it, will not affect your ability to build vehicular pavement within 10 feet of your property line. The worst-case scenario that I can envision would be the possibility of some difficulty planting shrubbery on the slope of the open drainage channel. This could result in the necessity to build a 3'-high fence or wall at your northwest corner, in lieu of landscaping, to satisfy screening requirements.
