Road Improvements Construction and Escrow Agreement
for Harris/Bethel Road

I have read the referenced document and have the following comments:
1)
On Page 2 Section 1.2, reference is made about the City
obtaining necessary right of way within three months. Exhibit
D shows the proposed location of that right of way to be on the
north side of Bethel School Road between Plantation Drive and
Harris St. This section is adjacent to a platted subdivision.
The necessary right of way should have been dedicated when the
property was platted. If that is the case, then the last
sentence of Section 1.2 could be deleted. However, if right of
way is actually needed it probably would take longer than three
months to obtain, considering the appraisals, offers and
possible condemnation.
2)
On Page 3 Section 1.4 (b), reference is made to the City
approving the selection of the engineer and contractor. This
is unusual.
3)
On Page 3 Section 1.5, reference is made to "reasonable access"
during construction. "Reasonable access" should be defined.
There has already been verbal request for the City to close
down the street during construction.
4)
On Page 3 Section 2.2, reference is made to the City obtaining
necessary temporary construction easements. Shouldn't this be
the developers responsibility?
5)
On Page 5 Section 3.1 (c), reference is made to a City escrow
contribution of $42,000. Who calculated that number?
6)
On Page 8 Section 4.3, reference is made to disbursement of
remaining escrow funds after the street is constructed and
approved by the City. Based on the language contained in the
escrow agreement with Centex, it's possible that they also may
need to be included in any disbursement o~ remaining ffunds.
7)
On Page 8 Section 4.4., reference is made to the "parties". Is
that word referring to the developers?" If it stays "parties",
then it appears that the City could incur some cost associated
with paying the fee to the escrow agent.
