AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, A1V[ENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS
HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING ON THE HE1R. EINAFTER
DESCRIBED PROPERTY TO THE NE~A? ZONING CLASSIFICATION HEREIN STATED;
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED
THE SUM OF T~O HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission and the Governing Body of the City of
Coppel], Texas, in compliance with the laws of the State of Texas with reference to
the granting of zoning changes under the zoning ordinance and zoning map, have given
requisite notices by publication and otherwise, and after holding due bearings and
affording a full and fair hearing to all property owners generally, the said Governing
Body is of the opinion that said change of zoning which is on application of Braewood
Development Corp. should be granted and the Comprehensive Zoning Ordinance of the
City of Coppe]l should be amended in the exercise of its legislative discretion:
NO~, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell,
Texas, be and the same is hereby emended by amending the Zoning Map of the City
of Coppe]l, so as to give the hereinafter described property the following zonin~ district
elassi fica ti on:
Change from "C" Commercial District Classification to "SF-7" Single Family Dwelling
District Classification, said property being described as follows:
TRACT #1:
BEING a tract or pace] of land situated in the City of Coppell, Dallas
County, Texas; and being part of the E. Crow Survey, Abstract No.
301, and being more particularly described as follows:
BEGINNING at a point for corner in the northerly right-of-way line of
Bethel School Road (40 feet wide) said point b~ing north 85 deg. 28'
00" east a distance of 221.54 feet from the northeasterly cut-off line
of the said northerly right-of-way line of Bethel School Road and the
easterly right-of-way line of Denton Tap Road (100 feet wide);
THENCE north 0 deg. 37' 00" east a distance of 10]_8.94 feet to a point
for corner in the southwesterly line of a Lone Star Gas Company
right-of-way (50 feet wide); ·
THENCE south 58 deg. 18' 20" east along the said southwesterly line
of a Lone Star Gas Company right-of-way a distance of 311.37 feet to
an angle point;
THENCE south 0 deg. 37' 00" ~,est a distance of 834.18 feet to a point
for corner in the said northerly right-of-way line of Bethel School Road;
THENCE south 85 deg. 28' 00" .west along the said northerly ri.a'.ht-of-way
line of Bethel School Road to the POINT OF BEGINNING End containing
247,094 square feet, more or less, or 5.6725 acres.
TRACT #2:
BEING a tract or parcel of land situated in the City of Coppell, Dallas
County, Texas; and being part of the E. Crow Survey, Abstract No.
301, and being more particularly described as follows:
COMMENCING at the southeaster]v cut-off line of tbe easterly right-of-
way line of Denton Tap Road (100 ~eet wide) and the southerlY; right-of-
way line of Sandy Lake Road (60 feet wide); ~
THENCE south 2 deg. 09' 00" east along the said easterly right-of-way
line of Denton Tap Road a distance of 595.10 feet to a point for corner;
THENCE south 89 deg. 23' 00" east a distance of 303.60 feet to the
POINT OF BEGINNING;
THENCE south 89 deg. 23' 00" east a distance of 266.68 feet to a point
for corner;
THENCE south 0 deg. 37' 00" west a distance of 1314.21 feet to a
point for corner in the northeasterly line of a Lone Star Gas Com_oany
right-of-way (50 feet wide);
THENCE north 58 deg. 18' 20" west along the said northeasterly line
of a Lone Star Gas Company right-of-way a distance of 311.37 f~et to
an angle point;
THENCE north 0 deg. 37' 00" east a distance of 1153.48 feet to the
POINT OF BEGINNING and containing 329,041 square feet, more or
]ess, or 7.5537 acres.
SECTION 2. That all ordinances of the City in conflict with the provision of
this ordinance be, and the same are hereby, repealed and all other ordinances of the
City not in conflict with the provisions of this ordinance shall remain in full force
and effect.
SECTION 3. That the abovc described property shall be used only in the
manner and for the purposes provided for in the Comprehensive Zoning Ordinance of
the City, as amended herein by the granting of this zoning classification.
SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase
or section of this ordinance be adjudged or held to be unconstitutional, illegal or
invalid, the same shall not affect the validity of this ordinance as a whole or any Dart
or provision thereof other than the part so decided to be invalid, illegal or
unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance
as a whole.
SECTION 5. That any person, firm or corporation violating any of the provisions
or terms of tb~s ordinance shall be subject to the same penalty as prov~aed for in the
Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon
conviction shall be punished by fine not to exceed the sum of two hundred dollars
($200.00) for each offense, and that each day such violation shall continue to exist
sba!l constitute a separate offense.
SECTION 6. It is necessary to ~ive the property described herein the above
mentioned zoning classification in order to permit its proper development and in order
to protect the public interest, comfort and general welfare of the City. Therefore,
this ordinance shall take effect immediately from and after its passage and publication
of its caption, as the law in such cases provides.
