HISTORY:
The property was platted in June of 1988. In November of 1989, the
property was rezoned from SF-12 to SF-12, Special Use Permit, to
allow the operation of a church, day nursery and school. In July of
1998, the Church received a temporary variance from the Board of
Adjustment to allow a temporary 1,200 sf shade structure for a
period not to exceed 24 months. In the beginning of this year, City
Council approved a 15,265 sf addition consisting of a sanctuary,
fellowship hall, and additional classrooms on this property.
TRANSPORTATION:
Heartz Road is a C2U, 2-lane undivided collector street contained
with 50' of right-of-way.

COMPREHENSIVE PLAN:
The Comprehensive Plan shows the property as suitable for
public and institutional uses.
DISCUSSION:
When the applicant came forward with the Site Plan review for the new
sanctuary, fellowship hall and classrooms, he mentioned during the public
deliberations that once the church additions were complete the shade
structure would be moved to an inner courtyard area. Due to minor
structural changes to the building under construction, the shade structure
will no longer fit in the inner courtyard area. Thence, the applicant is
requesting to bring the shade structure up to code.
City code requires all accessory buildings greater than 150 sf to be an 80%
masonry construction. Therefore, the applicant is proposing to brick the
existing metal posts. The brick to be used on the posts will match the
building (#132 Houston Gray). Staff had some concern with regards to the
durability and maintenance of the existing canvas. Applicant has
furnished staff a write up on the composition of the canvas and its
resilience. A note has been provided on the face of the Site
Plan/Landscape Plan that states "the canvas cover will be maintained in a
top quality/first-class condition, free from fraying, rips or fading".
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
Staff recommends approval of the site plan amendment.

-- herebnder remain the property of the SELLER until they are fully paid. Product warrantees do
not alSply until balances due are fully paid.
2.)If an~,. legal action is commenced to enforce the terms of this contract, the prevailing party
shall be entitled to reasonable attomey's fees, collection costs and court costs. The venue of
any proceeding hereunder shall be in Orange County, CA, and shall be heard and determined by
a referee pursuant to California Code of Civil Procedure Section 638.1 in effect as of the date
hereof.
3.)BUYER may cancel this transaction at any time pdor to midnight of the third business day
after the date of this transaction. As this order will be custom fabricated to fit the specific needs
of the BUYER, the deposit is not refundable if cancellation occurs after the third business day.
4.)BUYER is responsible for general care and maintenance of product. SELLER is not
responsible for damage from acts of God, vandalism, neglect or improper use.
5.)SELLER transacts with BUYER under the owner/builder contractor concept. Any permits that
are required are the responsibility of the BUYER. SELLER will carry no responsibility should
authorities object to the structure at any stage whatsoever.
6.)For foundations, firm, stable and digable ground is required. Should it appear that there is any
variation to the ground in the form of backfill material, rocks, etc. and/or unknown underground
pipe lines that require relocation, any extra work needed to excavate will be charged to BUYER.
No plumbing, electrical work, carpentry, masonry, plastering or painting is included in the work to
be carried out by SELLER and/or SELLER's contractor. SELLER will not be responsible for any
damage to any building or part of building on which the job has been carded out resulting from
faults or deterioration already existing in and around the building structures. SELLER will, in the
course of installation, take reasonable steps to prevent damage to existing gardens, lawns and
properly, but does not undertake to restore areas affected to odginal condition.
7.)Quotation pdce valid for 30 days from date hereof.
8.)SHADE STRUCTURES is continually working to Improve its product and reserves the right to
discontinue or change specifications in the future.
WARRANTY
SH^DE STRUCTURES guarantees its product, when used in its designed capacity, for a period
of five (5) years from odginal installation against:
-the steel frame corroding or deteriorating under normal conditions
-the steel frame deteriorating from faulty workmanship
-inappropriate design of supporting structure
-excessive loss of color of the fabdc under normal exposure conditions, including sunlight, rot
and normal atmospheric chemicals which may render it unsewiceable
-any tearing or blow-outs due to wind caused by improper installation or design. Under extreme
wind conditions that exceed our design capacity, it is advisable to remove the shade fabdc from
the structure.
Note: This warranty does not cover acts of God, vandalism, neglect or improper use. This
warrantee holds true for damage caused to shade fabric under normal conditions. Design of
structure does not include snow loads.
In the unlikely event of the shade fabric failing during lhe five (5).year periqd from lhe date of
original installation, SHADE STRUCTURES will supply th~ original owner of the fabric a new
fabric free of charge.
