Dear Mr. Powell:
I have in my possession Mr. Daneshmand's letters of Septem-
ber 29, 1986, to Kevin C. White regarding the City of
Coppell's ("City") requirements for unconditional site plan
and plat approval for the proposed development at the
northwest corner of Denton Tap Road and Sandy Lake Road.
It is imperative for both American Stores Properties, Inc.
and Connell Development Company ("Connell") to know the
City's exact requirements for unconditional site plan and
plat approval. Per the letters, that approval is
conditioned on resolution of the drainage system issue.
My request is to have the City specifically set forth the
items needed with respect to the drainage system. Is City
approval of the plans and specifications for the closed box
culvert necessary? Has it been given? Is a signed contract
for construction of the closed box culvert necessary? Will
you require bonds from the contractor and/or Connell Devel-
opment Company? If so what type of bonds and in what
amount? Is an escrow of funds necessary to pay the con-
struction contract necessary?
Per the letter of September 29, 1986, I note that a ded-
icated drainage easement, "Hold Harmless Agreement" and a
"Release of Liability" from all property owners is neces-
sary. Kevin White tells me this may no longer be so in
light of new plans. Is this true? If the documents are
still required, have they been received?
