City Council rezoned the property to "C" Commercial in October of 1995,
in compliance with the terms of an agreement settling a lawsuit. During
first quarter of 1998, the applicant submitted a commercial planned
development zoning change request which both the Planning and Zoning
Commission and City Council denied. A preliminary plat was approved
for this site early in 1998 and the final plat and site plan were approved on
April 14, 1998. The final plat was not submitted for City signatures
prior to the October 14, 1998 expiration date. Therefore, the original final
plat is deemed null and void and a re-submittal is required.
TRANSPORTATION:
MacArthur Boulevard is a 4-lane divided thoroughfare built in a
110'-wide right-of-way shown on the thoroughfare plan as a P6D,
6-lane divided thoroughfare.

COMPREHENSIVE PLAN:
The Comprehensive Plan shows the property as suitable for
regional retail uses.
DISCUSSION:
The submitted final plat conforms to the city regulations. When
the site plan for Lot 2 was approved with a shared driveway
between Lot 1 and Lot 2, it caused the western property line for
Lot 1 to shift 39.99' to the east. As this plat was never recorded
with Dallas County, the applicant is re-submitting the plat
indicating the new location of the western boundary line for city
approval. The engineer for this project has informed staff that the
shared access easement previously shown on this site and on the
future Burger King tract to the north (Lot 3, Block 1) was
incorrectly shown. The width of the shared access easement on
this site is 12.5' and 11.5' on the Burger King site. Previously, the
plat showed the easement evenly split between the two lots at 12.0'
on each side. The Burger King applicant has been notified and will
make the minor 6" correction on their plat.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
The planning staff recommends approval of the final plat.
