The Board of Adjustment met on Thursday, January 7, 1999, in the City Council Chamber~
Town Center, 255 Parkway.

ITEM 1: Call to order at 7:30 p.m. by Chairman Stonecipher.
Commissioner Wewers was invited to step forward and serve on the Board in the absence of
Commissioner Glasener.
ITEM 2: Approval of Minutes from December 3, 1998 Meeting.
Motion was made by Commissioner LeGros that the minutes of the December 3, 1998 meeting be
approved as written. Motion was seconded by Commissioner Jamadar, and a vote was taken. Motion
carried, 5 to 0.
Chairman Stonecipher administered the oath for all members of the audience wishing to speak either
for or against the requests being presented at this meeting.
ITEM 3:
Public Hearing to consider a request for a variance from Sections 33 and 34-1-8 of the
City's Zoning Ordinance, to amend the landscape requirements for the property located
at the northwest comer of MacArthur Blvd. and Beltline Road. Mr. David Cannon is
requesting the variance to allow the 7200 sq. ft. of required perimeter landscaping to
be incorporated in the interior landscaping.
Greg Jones reported that this request was submitted at an earlier date, but withdrawn prior to the
hearing date. This current request involves the perimeter landscaping buffer requirements. He noted
that this property consists of about five different parcels, and the applicant is requesting a variance to
allow the elimination of the perimeter landscaping from the shared property line between lots #1 and
#2. To make up the shortfall, the applicant proposes to incorporate that shortfall within the interior of
lot//2. He reported that although the request doesn't exactly comply with the Ordinance, the
applicant meets the landscaping requirements. He noted that Staff recommends approval of this
request.

Referring to the drawings, Greg Jones pointed out the area which does not comply with the
Ordinance, adding that if the applicant removed the property line between the two parcels, there
would be no need for a variance.
Commissioner Jamadar commented that the central line of the property runs directly down through the
alley, and the alley is already paved. Greg Jones responded that if the Board grants this variance, the
applicant would be required to return to the site plan review process, and because the first parcel has
already been platted, the applicant will need to go through the re-platting process to move the
property line.
Commissioner Jamadar asked for clarification on the current location of the alley, and Greg Jones ~
replied that the alley is currently located within Lot #1; there are two buildings on the site, and the
alley is within that parcel. Commissioner Jamadar asked about street frontage, and Greg Jones
indicated that there is no street frontage on the back parcel, only a fire lane. Commissioner Jamadar
commented that the intent of this section of the code seems to be to provide screening from the street.
Commissioner Wright asked if the granting of this variance would affect the calculations in the
number of trees, and Greg Jones indicated that this request is simply a substitution and that the correct
square footage of landscaping is being provided. He further reported that the details of the
landscaping plan would be addressed and enforced by Planning and Zoning, as well as City Council.
David Cannon, architect for the project, explained that the property hardship in this case is the
unusual shape of the lot, coupled with the easement running through the middle of the property which
creates a problem in the development of the north side without violating the perimeter landscape
ordinance. He noted that to compensate for this problem, the applicant has agreed to take the
required square footage of perimeter landscaping that would be lost and place it out in front of the
buildings, resulting in better use of the landscaping.
The meeting was opened to the public. No one spoke in favor of or in opposition to the variance
request.
The meeting was closed to the public and opened to the Board for discussion.
Chairman Stonecipher requested a 5-minute recess in order to speak with City Attorney, Robert
Hager, in executive session.
The Board reconvened. Commissioner Wright made a motion that the variance be granted to allow
the 7200 sq. ft. of required perimeter landscaping to be incorporated within the interior of the
property. Motion was seconded by Commissioner LeGros, and a vote was taken. Motion carried, 5
to 0. Variance granted.
ITEM 4: Public Hearing to consider a request for a special exception from Section 31-6 of the
City's Zoning Ordinance regarding parking requirements, for the property located at
the east side of Royal Lane, between Gateview and Cottonwood Branch, in the
Freeport North Industrial Park. Ms. Alice W. Lee is requesting this special exception
to allow for a reduction in the number of parking spaces from the required 290 parking
spaces to 80 for the proposed office warehouse.
