THAT.the term Grantor used herein shall be construed in the singular or
such term respectively represents one or more than one person.

THAT METROPOLITAN DALLAS, known herein as GRANTOR, in consideration of the
sum of One and no/100 Dollars ($1.00) and other good and valuable consideration in hand paid by
City of Coppell, Texas, receipt of which is hereby acknowledged, does by these presents grant,
bargain, sell and convey unto City of Coppell, Texas, ("GRANTEE"), the free and uninterrupted
use, liberty and privilege of passage in, along, upon and across the following described property
owned by GRANTOR (the "easement strip") for the purpos6 of constructing access and utility
improvements across GRANTOR'S main tract with the right and privilege at all times, of the
GRANTEE herein, its agents, employees, workmen and representatives having ingress, egress, and
regress in, along, upon and across said premises (the "easement") for the purpose of making
additions to, improvements on and repairs to said access and utility improvements or any part
thereof.
PRESEN
Said easement strip being described in Exhibits "A" and "B" attached hereto and made a
part hereof for all purposes.
In the event that an altemate easement is dedicated by a plat, and alternate infrastructure
facilities are provided which are acceptable to the City of Coppell, the City agrees, that by
accepting this easement and upon approval by the City Council, to abandon all right, title, and
interest of the City of Coppell, Texas, in and to the easement provided herein, or any portion
thereof, and to quitclaim such right, title and interest to the abutting property owner(s) in
accordance with its (their) respective interest(s).
That in consideration of the benefits above set out, GRANTEE will remove from the
easement strip, such fences, buildings and other obstructions as may be found upon said property,.
After construction of the access and utility improvements has been completed GRANTEE shall,
except for removed obstructions, remm the surface area of the easement strip to its original
condition as nearly as practical taking into consideration the nature of the work being performed.
GRANTORS reserve the right to use and maintain the surface of the easement strip for purposes
which will not interfere with GRANTEE'S rights hereby granted and agree that upon completion of
the access and utility improvements and restoration of the surface, GRANTEE shall not be
obligated for future maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell Texas, its successors or assigns for
the purposes aforesaid, the premises above described.

ACCESS AND UTILITY EASEMENT
BEING a tract of land situated in the S.A. & M.G.R.R. Survey, Abstract No. 1430 in
Dallas County, Texas and also being part of Lot 1 in Block 1 of Coppell Family Y.M.C.A., an
addition to the City of Coppell as recorded in Volume 98143, Page 2406 of the Deed Records of
Dallas County, Texas and being more particularly described as follows:
BEGINNING at a point on the east line of Town Center Boulevard (a 28 foot right-of-
way) and being the southwest comer of said Lot 1, Block 1, said point also being the northwest
comer of Lot 1 in Block 2 of Town Center Addition, an addition to the City of Coppell as
recorded in Volume 97093, Page 3963 of the Deed Records of Dallas County, Texas;
THENCE N. 01°00'58'' W., 32.11 feet along the said east line of Town Center Boulevard
to a point for comer, said point being the beginning of a curve to the right having a central angle
of 00°15'34'' a radius of 286.00 feet and a chord beating of N. 00°53'11" E.;
THENCE along said curve, and continuing along the said east line of Town Center
Boulevard, 1.29 feet to the end of said curve, a point for comer;
THENCE S. 41 °25'48" E., 7.00 feet leaving the said east line of Town Center Boulevard
to a point for comer;
THENCE N. 89°09'49" E., 20.00 feet to a point for comer;
THENCE S. 01000'58" E., 20.00 feet to a point for comer;
THENCE S. 75°I 1 '20" E., 30.00 feet to a point for comer being on the south line of said
Lot 1, Block 1} and also being on the north line of said Lot 1, Block 2;
THENCE S. 89°09'49" W., 53.40 feet along the common property line between said Lot
