TEXAS 75019 February 23, 1998 Ms. Patsy Gutierrez 302 Copperstone Trail Coppell, Texas 75019 RE: Public Access to Andrew Brown Park West-Copperstone Subdivision Dear Ms. Gutierrez: You have requested that I explain how the residents of our Copperstone subdivision might alter a condition of the subdivision final plat which states that public access will be provided to Andrew Brown Park. In consultation with our City Attorney, and as explained to you in our conversation, the proper procedure to follow is to replat the property requesting that the public access easements be removed. State law mandates that we send mailed notices to all property owners who own land in the subdivision, and that mailing cost is charged to the requesting party as well as a replat fee to process the request. Any engineering fees would also, of course, be the applicant's responsibility. The replat process takes approximately 60 days--that assumes the application submitted meets all replatting requirements--with both the Planning Commission and City Council deliberating the merits of the request in public meetings. One would initiate the process through my office, so if you decide to proceed we will be your contact here at Town Center. I also stated that when Copperstone was initially platted, the subject of public access to Andrew Brown Park was discussed at length. In the final analysis, and with staff and Commission support I might add, the plat was approved with the access easements shown. I will close by stating that staff feels the access easements are appropriate and we discourage attempts to eliminate them from the subdivision.
