Re: Briscoe Clark Co. Declaration (Copperstone)
Dear Isabelle:
Pursuant to your request, the undersigned reviewed the proposed Declaration of
Covenants, Conditions and Restrictions by Briscoe Clark Company, Ltd. and provide the
following comments.
Assuming that the use and other restrictions are consistent with the City zoning and
other applicable regulations, the proposed "Declaration" is acceptable except as noted
herein. A provision should be added to allow the City to perform the necessary
maintenance of the common areas with the ability to assess the expenses as a lien in the
event the HOA fails to maintain such property. In addition, the specific common areas to
be maintained by the Declarant and eventually by the HOA should, to the extent possible,
be described beyond the present definitions by reference to the plat or by legal description.
That is to say, if there are specific common areas to be shown on the plat or otherwise such
areas could be specifically included in the definition of "common areas" or "common
maintenance areas." Finally, the City should review the restrictions to ensure consistency
with the zoning and development conditions for the property.
