Box 478 Coppell, Texas 75019 ~: Site Plan and Plat Approval Dear Mr. Sieb: You have asked us whether or not the agreement whereby North America Properties/Southwest agreement to construct entry features on the east and west intersection of Town Center Boulevard at Parkway constitutes an enforceable obligation of the developer for construction of signage. Upon review' of the minutes of the Planning & Zoning Meeting, the staff report, and the City Council minutes regarding the same, it is our conclusion that the offer a to build a decorative wall and entry features at said intersection of Town Center Blvd. at Parkway Blvd. constitutes a regulatory and contractual obligation of North American Properties/Southwest to construct the signage. The developer in this case offered to build and construct the decorative walls in lieu of consideration for removal of other signage and entry way issues on the site plan and preliminary plat. As such they form a regulatory and contractual obligation of North American Properties/S:)uthwest which we deem ~. legally enforceable obligation. We hope this satisfies your inquiry as to the obligations of North American Properties/Southwest concerning the signage at Town Center Boulevard at Parkway.
