RE: 1995 Replat of Part of Estates of Cambridge Manor
Dear Jack:
The title company called me yesterday, after I had talked with you. According to them,
ownership of your subdivision transferred to a different entity after the filing of the initial plat
for Estate of Cambridge Manor, and prior to the submission of the replat of Lots 8, 9 and 10
of Block B. While the parties involved may have remained the same, apparently the title
company lawyers consider this no different from my replatting my neighbor's lot (which I have
no authority to do). Therefore, it would appear that the 1995 replat of these 3 lots is invalid.
This is what I suggest. Let's not do another replat for a couple of good reasons. First, you
have already sold Lot 8R by reference to the presumably invalid replat. Second, residential
replats require a public heating and notification of all owners within the original 46-1ot
subdivision. Therefore, instead, let's do an amending plat of the original 46-1ot subdivision.
Notice, a hearing, and the approval of other lot owners are not required for the approval and
issuance of an amending plat. City Council has the authority to approve and issue an amending
plat, which may be recorded and is controlling over the preceding plat without vacation of that
plat, if the amending plat is signed by the applicants only and is for one or more of the
following purposes: 1) to correct an error in a course or distance shown on the preceding plat;
2) to add a course or distance that was omitted on the preceding plat; 3) to correct an error in
a real property description shown on the preceding plat.
So what you need to do is redraw the original 46-1ot subdivision with the correction to the
boundary that you made on the 3-lot replat. Call it an Amending Plat of Estates of Cambridge
Manor. We will take it to City Council for approval.
