Date: Wed, Nov 22, 2000 8:50 AM Subject: Re: Replat Conditions - Everybody Fits Mark, I have reviewed this with Mike Martin, he has determined that 1,3,and 4 are O.K. We will be verifying with the City Attorney the appropriate means to assure maintenance of the medians. You are fine to resubmit as is, and if we need further "word smithing" we can accomplish that prior to filing. Have a great Turkey Day! Marcie >>> Mark Donaldson <mdonaldson@daa-civil.com> 11/21 4:11 PM >>> Marcie: I want to respond to the four conditions that were placed on the P & Z recommendation regarding the Replat and Minor Plat of Everybody Fits. 1. TXU gas and electric on one line. NO PROBLEM. 2. Maintenance of medians. THE NOTE (#1) ON THE FACE OF THE PLAT AS SUBMITTED READS: "LOT 2X, BLOCK A, AND OTHER MEDIANS IN THE RIGHT-OF-WAY TO BE OWNED AND MAINTAINED BY OWNER OF LOT 2R, BLOCKA." DOESN'T THIS DO WHAT YOU WANT? 3. Volume and page for "existing" 20' water easement. After researching this issue, I have concluded that there is no recording information for the "existing" 20' water easement because the easement wasn't on the plat that was recorded, and I have found no evidence of a separate instrument. When we identified an "existing" water easement on previous submittals, we were mistaken. SO, THE 20' WATER EASEMENT WILL BE RECORDED ON THE REPLAT. 4. TXU easements may be needed. TXU EASEMENTS AS REQUESTED BY TXU ARE ON THE REPLAT. GAS AND ELECTRIC EASEMENTS ARE LOCATED AT THE SOUTH END OF THE EXISTING BUILDING. THE ELECTRIC EASEMENT HAS BEEN MODIFIED TO ACCOMMODATE A NEW TRANSFORMER AND THE TXU PREFERRED PATH TO THE EXISTING UTILITY EASEMENT. To summarize: the signature line for TXU will be changed. I think the other three conditions have already been addressed. WHAT DO YOU THINK? Have a nice thanksgiving. See you next week with 17 folded, full-sized copies and 3 reductions. Mark
