Re: Heartz Road Construction - Development AGreement (the "Development
AGreement") between Parks of Coppell Joint Venture II ("Venture") and
ABQ Development Corporation ("Company") dated May 24, 1988 and
Agreement to Sell and Purchase ("the Sales Agreement") between
Venture and Ccmpany dated April 13, 1988.
Dear MS. Bowman:
In order for the proposed construction of Heartz Road to c~mply with
agreements bet~-=en the Venture and the Ccmpany, certain revisions to the
plans specified herein are necessary. The following are the comments and
requirements of the Venture based on advice from its civil engineer,
Roberts and Dowdey, on the proposed preliminary plat for Heartz Road and
related preliminary construction plans which have been submitted to the
city for approval by the Ccmpany. Please for~rd these requirements to
the appropriate city representatives.
1. Because the preliminary plat does not oontain sufficient
information to verify whether the proposed road location is as
required in the Development Agreement, we reserve the right to
require that the road De located as required in the Development
Agreement upon review of a final plat.
2. The Venture requires that an additional santitary sewer line be
added to the Utility Facilities in the Heartz Road right of
way, at locations and of a size to adequately provide sanitary
sewer service to all of the Town Center Site and the Ccmpany
Site which are to be sewered by utilities located in Heartz
Road. We are advised that the existing eight inch line in
Heartz Road is already at or near capacity. The Develo~u-ent
AGreement requires that the Utility Facilities to be
constructed in Heartz Road contain sufficient capacity to allow
the development of both the Town Center site and the Cc~pany
site to the maximum densities permitted under the zoning
designations of the two properties. The current zoning
designations allow up to 20 acres of land out of the Town
Center Site along the west side of Heartz Road to be used for
MF-2 densities, while the remaining acres in the Town Center
Site may be all developed for cc~erical uses. All of the
Company Site may by used for MF-2 densities.

therefore we request that a determination be made of the size
of the additional sanitary se~r facilities required to
sufficiently serve these permitted uses.
3. The Venture requires that fire hydrants be constructed as a
part of the Utility Facilities along Heartz Road in a manner
ccmplying with the ordinances of the City of Coppell.
4. A review of the proposed plans indicate that the box culvert to
be constructed at the linear park crossing is not located
correctly on the plans. The Venture requires that this should
be corrected.
5. In keeping with the Development Agreement and the Sales
Agreement, the Venture requires that the storm drainage system
to be constructed in Heartz Road should be extended within the
right of way of Heartz ~oad all the way to the intersection of
Heartz Road and Sandy Lake Road, and shall be connected to the
existing storm drainage system in Sandy Lake Road.
6. Such other matters that subsequent review may indicate to not
comply with the requirements of the Development Agreement or
the Sales AGreement.
As you know, the Venture reserved its right to require such revisions as a
condition of signing the preliminary plat application. The city should
not approve the proposed plat until such time as the Venture verifies in
writing to the city that the required revisions have been agreed between
the Venture and the Company. Please call me if you have any questions.
