Dear Mike:
Enclosed are two copies of metes and bounds descriptions of
proposed easement areas on The Parks of Coppell Joint Venture II
property. An exhibit showing the easement area is attached to
each description. These areas will contain sanitary sewer and
storm drainage facilities to be constructed with improvements in
Heartz Road as shown on the construction plans. The City of
Coppell is requiring these easements as a condition for approval
of the construction plans of Heartz Road.
The City staff has advised us that they are not aware of any
standard easement forms used by the City for dedication of
drainage and utility improvements.
Please prepare and execute easement dedication instruments
formally dedicating areas shown on the enclosed exhibits to the
City. You may return these instruments to me or submit them
directly to Russell Doyle in the Engineering Department.
James Arnold Construction is currently scheduled to begin
Subgrade Preparation in Heartz Road on May 15, 1989. Mr.
McCarley has advised me that the new pasture fences that will
confine his cattle to areas on ABQ property east of the drainage
channel and generally northeast of the east lake will be
completed by this Friday, May 12, 1989.
The Final Plat of Heartz Road was approved by the City Council on
May 9, 1989. A condition of approval was that ABQ construct the
full-width roadway adjacent to the Perkins tract. T~he City will
acquire this Right-of-Way. Utility and paving construction
"should commence only'-~(~'-' this Right-of-Way is secured. In
addition, this construction should follow grading operations
stated in the Development Agreement between ABQ and PCJV II.

We are awaiting your approval of the construction plans requested
in my letter to you of April 29, 1989. A signed statement by
your engineer, Mr. Dan Dowdey, P.E., evidencing his acceptance of
these construction plans (two exceptions noted) was received by
our office on April 28, 1989.

BEING a 300.00 square feet tract of land located in the S.A. &
M.G.R.R. SURVEY, Abstract No. 1430, City of Coppell, Dallas
County, Texas, and also being a portion of a tract of land
conveyed to THE PARKS OF COPPELL JOINT VENTURE II by the deed
recorded in Volume 81239, Pages 1386-1390, of the Deed Records of

COMMENCING at an iron rod at the Beginning of a Curve to the
Right, said iron rod being the most northwest corner of a

and also lying in the existing south Right-of-Way line of
