Dear Taryon:
Enclosed is an original of the above ordinance and several copies. Also, enclosed
is an original and copies of a Caption for publication. When adopted a copy of the
ordinance should be sent to the proper department to update the zoning map.
When this zoning change was approved the applicant volunteered the following: (i)
to deed restrict the lots in Blocks A and B of Tract I to 70 foot minimum width; (ii) to
make the linear park in Tract I a common area with a pedestrian easement for egress and
ingress, to be maintained by a homeowners association; (iii) to deed restrict lots in Tract II
to a minimum of 8000 square feet with an over all average of 9000 square feet; (iiii) to
deed restrict lots in Tract II to a 70 foot minimum width and provide a method to make
homeowners aware of future park lighting to the north at the time any earnest money
contract is signed.
Because this is regular zoning, special conditions can't be placed in the ordinance.
Therefore, the final plat should show these restrictions and the city should be provided with
a copy of the Declaration of Covenants and Restrictions (sometimes called the Homeowners
Association Agreement) containing provisions similar to the matters mentioned in my letter
to Ken Griffin dated January 21, 1993, a copy of which I am enclosing.
