Box 478 Coppell, Texas 75019 214 - 462 - 0022 October 14, 1988 Ted Hager Hager Containers, Inc. 12855 Valley Branch Lane Dallas, Texas 75234 Dear Mr. Hager: Hager Containers has requested approval to construct a 98,000 square foot building with a sixty foot minimum setback from three property lines. The proposed building would be set back twenty- four feet from the north property line. The building use has been determined to be a type B2 occupancy and the proposed building is a type II-N structure. The building will also contain an automatic sprinkler system. The structure will consist of two floors. The first floor will have an area of 94,000 square feet while the second floor will be 4000 square feet. In order for a building as described above to be constructed, there must be a sixty foot setback from the building to all property lines. Mark Connell of Connell Development Company, the owner of the property abutting the northern property line of the Hager Containers property, has offered to enter into a restrictive covenant agreement in favor of Hager Containers, Inc. which would preclude the construction of any buildings on the Connell property within a distance of thirty-six feet of the northern property line of the Hager Containers property. As a result of this proposal, a strip of land 36 feet wide and running parallel with the northern boundary of the Hager Containers property could not be used in the calculation for determining the building setback requirements for the Connell property, and the northern portions of this thirty-six foot strip would be considered as the property line for any development of the Connell property. Based on the above offer by Connell, the City of Coppell does not object to allowing the thirty-six foot strip to be used in calculating building set back requirements for the Hager Containers building.
