Gary Sieb is reluctant to approve this plat as a minor plat, since there has been neighborhood
involvement in previous development proposals on the property. Even if he were to consider
it, his authority to approve a minor plat is limited to plats which meet the letter of the law. City
Council, on the other hand, can grant variances to certain requirements.
I have reviewed the drawings you sent and find that the proposal contains several departures
from ordinance requirements, mostly pertaining to landscaping. By my measurement you appear
to be showing land utilization roughly as follows:

Interior parking lot landscape should be 10% of the parking lot area, so that is short by about
8,000 square feet. Landscape of non-vehicular areas should be 15% of the total site area,
interpreted to be that part of the lot not covered by building, or 15% of 208,600 = 31,290 s.f.
Even if the vehicular area landscaping were counted toward this requirement, total landscaping
still would be 8,000 square feet short. For Gary to approve the plat as a minor plat, you would
have to revise the site plan to show approximately 37,500 square feet more landscaping. By
going the Preliminary Plat/Final Plat route, City Council may make a few allowances.

Also, against Lots 7, 8 and 9 of Waters Edge, Phase 2, you are showing the parking area to
have a buffer 5.72 feet wide. The current requirement is 10 feet. A proposal to reduce the
requirement to 5 feet is in process, but may not survive.
The landscape buffer between the parking area and the two streets must include screen planting
at least 30 inches in height. A 6-foot-high masonry wall is needed to screen the loading area
from MacArthur Drive. In addition, please indicate by notation the location and height of the
brick wall along the north property line.
Finally, we believe there is opportunity to increase the amount of total landscape by adding
small islands in the handicap parking area, without impeding wheelchair access, and by adding
feature landscaping clements around the building.
Our recommendation is that you beef up the landscaping as much as possible and submit through
the Development Review Committee process. Give me a call if you want to discuss further.
