Since each of these properties address different issues and there is an extremely long agenda for that night, we request that Case # ZC-555(CH (the land area north of Parkway) be postponed to the June 28 heating date. Via Fax (214-393~1 PLANNING COMMISSION AUTHORIZED PUBLIC HEARING Case No. ZC-555 (CH) Location: North of Parkway Blvd. , east of Coppell Road Size: Approximately 90 acres Owner: Approximately 63 acres owned by Jim Sowell Co.; approximately 12.7 acres owned by Bonham State Bank; approximately 27 acres owned by John Adams Existing Zoning: MF-2 with the exception of a small portion of the Sowell tract (approximately 10 acres) which is zoned MF-1 Proposed Zoning: With the exception of a portion separated from the majority of the 90 acres, SF (with numerical classification to be determined at hearing); the remainder along north Coppell Road and separated by a drainage area, MF -2 Master Plan: Shows high density (apartments) and flood plain Recommendation: Based upon the current single-family market, and the fact that the majority of critical comments heard at the community public meeting in 1992 focused on this land area, "SF" appears most appropriate for this parcel with the exception of the tract along north Coppell Road (the Adams tract) and separated by the drainage line. It is staff's recommendation that parcel retain its MF-2 classification. Planning Commission Action of March 14, 1994: Retain "MF-2" on approximately 25 acres (the majority of the Adams tract), "SF-7" on the remaining approximately 75 acres (the Sowell and Bonham State Bank parcels). Please see next page for addffional information. / R HC o REHEARING ON ZC~555 After the Council had rezoned this tract to SF-9 (Planning Commission had recommended SF-7), there was additional dialogue held with the owner of this property (Sowell), and the Council elected to return the case to Planning Commission for additional study (please see the attached memo from City Manager Witt that outlines the general discussion held by Council), and possible action. Subsequent to Council's request and the mailing of notices calling the hearing for May 19, Mr. Jamie Cornelius--Jim Sowell's representative--submitted the attached letter which appears to take issue with Council's informal discussion. It appears that Mr. Cornelius was of the opinion that SF-7 was to be discussed, NOT SF-7 and any other zoning classification. At any rate, the notice was properly advertised, the Commission has already recommended SF-7 on the entire tract (which seems to track with Mr. Cornelius's position), Commission can still recommend to zone the property in any residential classification it feels is warranted, and we can proceed through the process of rezoning this property one more time. Staff would recommend the same as we did for the first hearing and that is to rezone from SF-9 to SF-7 on the entire parcel which has recently been rezoned SF-9 (remember at the time of rezoning to SF-7 the entire tract was zoned MF-1 or 2). We also support the original Commission recommendation of leaving the northwest corner of the area which is shown on the attached map, MF-2. 16. PUBLIC HEARING: Consideration and approval of Case #ZC-555(CI-I) Amended, zoning change from SF-9 (Single Family-9) to SF-7 (Single Family-7) or any other more restrictive district, located at the northeast corner of Parkway Boulevard and CoppeH Road, at the request of the City of CoppeH. Gary Sieb, Director of Planning and Community Services, made a presentation to the Council. Mayor Morton opened the Public Hearing and asked for those persons wishing to speak against this proposal. There were none. He then asked for those persons wishing to speak in favor of this proposal. Pat Atldns, 6330 Beltline, Garland, Texas spoke in favor of this zoning change. See Item #17 for motion and vote. 17. Consideration and approval of an ordinance for Case #ZC-555(CH) Amended, changing the zoning from SF-9 (Single Family-9) to SF-7 (Single Family-7) or any other relative district, located at the northeast corner of Parkway Boulevard and Coppell Road, at the request of the City of Coppell. Mayor Pro Tem Robertson moved to close the Public Hearing and approve Ordinance No. 91500-A-60 for Case #ZC-555(CH) Amended, changing the zoning from SF-9 (Single Family-9) to SF-7 (Single Family-7), located at the northeast comer of parkway Boulevard and Coppell Road, at the request of the City of Coppell and authorizing the Mayor to sign. Councilmember Stahly seconded the motion. The motion carded 5-2, with Mayor Pro Tem Robertson and Councilmembers Alexander, Stahly, Reitman and Sheehan voting in favor of the motion, and Councilmembers Watson and Mayo voting against the motion. 18. PUBLIC HEARING: (Continued from 6-14-94) Consideration and approval of a zoning change, Case #ZC-559(CH) from 2F-9, MF- 2 and LI to any appropriate zoning district classification, including, but not limited to, SF-7, SF-9, SF-12, SF-18, SF-ED, 2F-9, MF-1, and/or LI, on approximately 140 acres of land located along the west side of Coppell Road, along the north and south side of Ruby Road. Mayor Pro Tem Ron Robertson had filed a Conflict of Interest with the City Secretary on the item and withdrew from the Council at this time. Gary Sieb , Director of Planning and Community Services, made a presentation to the Council. Mayor Morton opened the Public Heating and asked for those persons wishing to speak against this proposal. Don Moulton, NCH Corporation, addressed the City Council and commented that NCH did not agree with the Planning Commissions' recommendations and submitted a letter withdrawing their Planned Development Proposal from consideration. Mayor Morton then asked for those persons wishing to speak in favor of this proposal. Chuck Sturges, 132 Newport Drive; Rick Burlingham, 492 Halifax; Martha Jo Cozby, 412 South Coppell Road; Pat Keenan, 412 Wellington; and Barbara Bailey, 232 Plantation; spoke in favor of this proposal. Mike Cogbum, 124 Heatherglen, addressed the Council regarding a public heating on July 18, 1994 to solicit input of all citizens regarding the Historical District located in this area. Councilmember Reitman moved to close the Public Hearing and approve Zoning Change Case #ZC-559(CH) from 2F-9, MF-2 and LI to LI on approximately 140 acres of land located along the west side of Coppell Road, along the north and south side of Ruby Road. Councilmember Mayo seconded the motion. Motion carded 6-0 with Councilmembers Alexander, Stahly, Reitman, Watson, Mayo and Sheehan voting in favor of the motion. Mayor Pro Tem Robertson returned to the Council at this time. 19. Necessary Action Resulting From Executive Session. There was no action to be taken as a result of Executive Session.
