We have modified the zoning exhibit to comply with the Letter of Conditions from Gary Sieb dated August 10, 1994. As Follows: We have modified item 12-3,1 (A.) FRONT YARD - to provide for a 30' front yard for (zoning area B) which is comparable to "SF 12" District and to provide for a 25' front yard for (zoning area A) which is comparable to a "SF 9" District. 2. We have modified item 12-3, 2 (C.) LOT DEPTH - One hundred ten (110) feet. 3. Item 12-3, 4 LOT COVERAGE has been revised to thirty five (35 %). Item 12-4 PARKING REGULATIONS have been revised to add Swing-entry garages for front-entry lots. Added Item 12-6 MAINTENANCE OF COMMON AREAS - The Homeowner's Association will be responsible for maintaining common area. Added Item 12-7 PEDESTRIAN BRIDGE - Foot bridge to cross Denton Creek, if the foot bridge is not approved, work with City to provide additional access along Denton Tap Road bridge as it is widened. The preliminary plat was submitted with all information require for the detailed site plan. Alleys on plat comply with alleys on zoning exhibit. Lot 51 has been dropped on the preliminary plat and the zoning exhibit revised. We did not stub an alley east but we will widen the lot adjacent to landscape Buffer. We will work with the City in order that a grant can be pursued. The developer will provide for the establishment of bermuda turf grass in the park site. We would like to discuss modification of this item to read.., provide for bermuda seeding in disturbed areas, also provide for native grasses and wild flowers in natural areas south of the lakes. We agree that landscape plans will show automated irrigation will be installed at or near the proposed playground. All playground specifications will be coordinated with the Parks and Recreation Division and will be accessible to challenged individuals. The developer will work with the City to provide additional access along the Denton Tap Road Bridge as it is widened, should the pedestrian/bike bridge not be approved across Denton Creek as proposed. We support the option of providing additional access along the Denton Tap Road Bridge VS. building the pedestrian bridge. We think it will provide a much better long range solution in that the pedestrian bridge built in the flood plain across the creek will eventually be damaged by flooding and have to be replaced. The Denton Tap Road Bridge will be built above the 100 year flood and will not face the almost certain risk of being under water or obstruction flow as the pedestrian/bike bridge will. We propose to dedicate funds to the Denton Tap Road Bridge in a comparable amount required to construct the pedestrian bridge across Denton Creek. Ms. Isabelle Moro Page 3 October 26, 1995 17. The developer agrees to provide aeration fountains within the two (2) proposed lakes. 18. We are currently setting up meeting with City Staff and the Park and Recreation Board to finalize the improvements to the proposed park site.
