Dear Taryon:
Mr. Parsons made application for replat of a particular subdivision, and the matter
has been placed on the Planning and Zoning Commission's agenda for their meeting on
November 19, 1987. Actually, the agenda item calls for the vacation of a previous
plat and consideration of approval of a new preliminary plat. The applicant, Mr.
Parsons, has contacted me concerning his desire to have the matter considered as a
replat rather than vacation of the previously recorded plat, since he is the owner of all
of the property involved.
It is my opinion that at the applicant's request and if the Planning and Zoning
Commission finds that the changes the applicant wishes to make are of such a nature
that it is not necessary to vacate the previous plat and that such changes can be
accomplished by replatting, the Planning and Zoning Commission may approve the
application as a replat and send it on to the City Council for consideration as a replat
in lieu of vacating the original plat. Therefore, I have no problem with the Planning
and Zoning Commission acting on the application as a replat even though it originally
comes to the Commission as the vacation of a previous plat. As a practical matter,
a replat accomplishes the same final result as does approval of a new plat after vacating
a previously recorded plat, replatting being the proper procedure where the requested
change does not require the complete elimination of the previously recorded plat.
