C. HEARING DATE: May 8, 1990 Northwest corner of Mockingbird Lane and the St. Louis and Southwestern Railroad. SIZE OF AREA: 3.77 acres REQUEST: Approval of the final plat along with the following variances: 1) Deletion of the alleys on Lots 2-9. 2) Allow Lot 1 frontage on Mockingbird Lane. 3) Waiver of centerline radius on Crestview Court to 75 feet (Comprehensive Subdivision Ordinance requires a minimum of distance of 425 feet. APPLICANT: Don Tipton Engineering 6330 Beltline Road, Suite C Garland, Texas 75043 HISTORY: Subject property was submitted to the City Council in May, 1989, and approved; however, the plat was not submitted to the City within the required six (6) month period, and the plat was deemed null and void. For this reason, a resubmittal is required. ANALYSIS: Applicant is requesting approval of a final plat along with variances. Since the final plat has not been amended since the last submittal, staff has no objections. ALTERNATIVES: 1) Approve the final plat 2) Deny the final plat ATTACHMENTS: 1) Final plat NLWE12.STF ITeM 11 DRAF PD-105. She further stated that the applicant is requesting approval of the replat, and staff has no objections. Mr. Bill Anderson of Dan Dowdey and Associates was present to represent this ite~ before the Commission. Chairaan Munsch then opened the public hearing and asked for persons wishing to speak in opposition to this request. There were none. He then asked for persons wishing to speak in favor of the request, again there were none. The public hearing was then declared Closed. Following discussion Comissioner Weaver moved to approve the replat for Meadows Addition, Section 3. Co~issioner Redford seconded the ~otion/ motion carried (4-0) with Chairman Munsch and Con~issioners Gross, Redford and Weaver voting in favor of the motion. Chairman Munsch stated that It~a #11 would now be moved up on the agenda, and considered at this time. Item 11: Consider approval of a final plat for Northlake Woodlands East #12 Addition, located at the northwest corner of the St. Louis and Southwestern Railroad and Mockingbird Lane, at the request of Don Tipton Engineers. P&Z Coordinator Taryon Bowman introduced the ite~ to the Commission. Ms. Bowman stated this final plat was previously platted and approved by Council in 1989. The plat was not filed and executed with the County; therefore, it was deemed null and void. She further stated that this plat carries nine lots on 3.77 acres of land. The applicant is requesting approval of a final plat along with the following variances: 1) 3) the deletion of the alleys on lots 2 through 9, to allow Lot 1 to front on Mockingbird Lane, and to grant a waiver of the centerline radius on Crestview Court to 75 feet. The Comprehensive Subdivision Ordinance requires a minimum distance of 425 feet. Ms. Bowman then stated that staff has no objections to this request. Mr. Pat Atkins of Don Tipton Engineers was present to represent this item before the Commission. Following discussion Commissioner Weaver moved to approve the final plat for Northlake Woodlands East #12. As we discussed during our telephone conversation, this case is scheduled for consideration by the Coppell City Council on May 9, 1989. A representative for this case must be present at the City Council meeting. Failure to represent this item may result in the denial of this application. Those conditions are as follows: 4. 5. 6. A homeowners association be required to maintain the common areas and the drainage area; That a letter of permission and working out of the common drainage problems be obtained from ABQ Development Company, with the approval of the City's Engineering staff; if the letter cannot be procured, that drainage problems be resolved with approval of the City's Engineering staff; That a note be placed on the plat that front entry houses will be built on property where no alleys are provided; Less than four foot encasement sanitary sewers be allowed on Lots B - 1, 2 and 3; That Beechwood Lane be curved to fit with the development of ABQ Development's property; That Pecan Hollow Addition be able to modify Lots C - 1, and B - 1 through 5, between now and the time it is brought before the City Council to fit in with that configuration; That the minimum curve radius of 425 feet be waived, and the computed centerline curve radius shall be allowed. Also present to discuss this item with the Council was Mr. Jerry Parche representing ABQ Development, and Mr. Cameron representing Gateway USA. Discussion was also held concerning a drainage easement that is needed to adequately drain this property. It would be required on Lots C - 1 through C-10. Following discussion on this item, Councilman Morton moved that the final plat be approved subject to the following conditions: 1. A homeowners association be required to maintain the common areas and the drainage area; 2. That a letter of permission and working out of the common drainage problems be obtained from ABQ Development Company, with the approval of the City's Engineering staff; if the letter cannot be procured, that drainage problems be resolved with approval of the City's Engineering staff; 3. Consider approval of a final plat for Northlake Woodlands East #12 Addition, located at the northwest corner of the St. Louis and Southwestern Railroad and Mockingbird Lane, at the request of Don Tipton Engineering. Director of Planning & Community Services, Gary Sieb, made the presentation to the Council. Mr. Sieb stated that the Planning & Zoning Commission has Applicant is requesting the following conditions: 1) deletion of alleys on Lots 2, 3, 6, 7, 8, 9; 2) allow lot one frontage on Mockingbird Lane; 3) waiver of cen~er line radius on Crestview Court to 75 feet. The comprehensive subdivision ordinance requires a minimum distance of 425 feet. Mr. Sieb indicated to the Council that this plat had been previously approved by the Council; however, applicant did not get it filed within the time frame as required. Therefore, it is required to be brought back before Council for approval. Following discussion on this item, Mayor Pro Tem Smothermon moved that the final plat be approved as pres~nted with the following conditions: Deletion of alleys on Lots 2, 3, 6, 7, 8, and 9; Allow Lot 1 frontage on Mockingbird Lane; Waiver of centerline radius on Crestview Court to 75 feet (Comprehensive Subdivision Ordinance requires a minimum distance of 425 feet). Councilman Morton seconded; motion carried 7-0 with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Morton, Cowman, Robertson and Nelson voting in favor of the motion. Item 18. Consider approval of a final plat for Lake Park Addition, located along the west side of MacArthur Boulevard, north of Deforest Road, and south of Denton Creek, at the request of Dan Dowdey and Associates. Director of Planning & Community Services, Gary Sieb, made the presentation to the Council. Mr. Sieb indicated that the Planning & Zoning Commission has recommended unanimous approval of this final plat with the following six conditions: 1. That a left turn lane be provided on Lake Park Drive at the intersection of MacArthur; and 2. That a combination masonry and wrought iron screening wall adjacent to this property on MacArthur be provided by the developer; 3. Minimum street centerline radius to be less than 425 feet; 4. Allow Circle Cove Drive intersection with MacArthur Boulevard alignment; 5. Exemption to the current Floodplain Management ordinance; and 6. Allow curved sanitary sewers. Mr. Glen Hinckley, applicant, was also present to discuss this item with the Council. Mr. Hinckley stated that he would agree to one- story homes on this development on Lots 1 through 11. Discussion was held concerning the possibility of flooding on the mud lift station, and was informed by the applicant that the developer is incorporating a storm drainage system on MacArthur to take care of drainage for this mud lift station. Following discussion on Chis item, Councilman Robertson moved that the final plat be approved with the following seven conditions: 1. That a left turn lane be provided on Lake Park Drive at the intersection of MacArthur; and 2. That a combination masonry and wrought iron screening wall adjacent to this property on MacArthur be provided by the developer; 3. Minimum street centerline radius to be less than 425 feet; 4. Remove from the tablet he consideration of Drainage Improvement Options proposed by the Connell Development Co., along the west side of Connell Skaggs Addition (Woodside Vill&ge) from Sandy Lake Road to the southeast corner of Coppell High School where existing culvert ends.
