The property has been zoned Retail for over 25 years. The
Historic Overlay designation was added in 1997.
TRANSPORTATION:
Bethel Road is a two-lane asphalt roadway shown on the
thoroughfare plan as a C2U two-lane undivided collector.

The Comprehensive Plan shows the property as suitable for
historic district uses.

DISCUSSION:
For many years this property has been occupied by a residential structure.
Currently the building contains offices and cable company equipment. A
tower and several satellite dishes are located behind.
Paragon Cable proposes to remove the satellite dishes and tower and build
a new fiber-optics equipment building. Upon completion of the building
Paragon plans to remove the existing residential structure and install
concrete pavement to provide a fire lane and two parking spaces.
Because the property is less than 80' wide, a 20'-wide building cannot
observe 30' side yards on both sides, as required by the "R" District.
Therefore, Paragon will request a variance to the side yard requirement
from the Board of Adjustment.
If this property were located adjacent to a residential zoning district, a 6'-
high screen wall would be required at the property line. However, even
though the property is quite close to Old Coppell Estates, there is an
intervening 6'- to 9'-wide strip of land between. That land is in the HO-R
District and appears to provide the only access to the adjacent land on the
north. Consequently, the screen wall requirement applies to that property,
because it is adjacent to Old Coppell Estates, and not to this property.
The proposed building is utilitarian in nature and appearance. However,
because it will be located more than 60' from Bethel Road, it will be
relatively unobtrusive. In fact, complying with C.I.¥.I.C.
recommendations in this instance...such as requiring a minimum 5:12
pitch roof...would draw more attention to the building than a building this
size deserves. Staff is of the opinion that downplaying the building as
much as possible, and letting it recede into the landscape, is the better
alternative.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
The planning staff recommends approval subject to Board of Adjustment
approval of a side yard variance.
ALTERNATIVES:
1) Recommend approval of the request
2) Recommend disapproval of the request
3) Recommend modification of the request
4) Take under advisement for reconsideration at a later date.
