Because Mr. Frank Bamburg is contracting to develop the property adjacent to this proposed wall, because he has a zoning application which will be reviewed by Planning Commission on November 21, and because we share your concern that it is not prudent business practice to expend funds to construct a masonry wall and then have it torn down, this letter serves to advise you that we will defer this wall requirement until the referenced zoning case (and subsequent subdivision) process has been resolved. This deferral is conditioned upon the wall being constructed if the zoning and subdivision requests of Mr. Bamburg are not consummated. Box 478 Coppell, Texas 75019 Re: Retaining Wall - Park Place Addition Dear Gary: I am writing this letter for the purpose of requesting a conditional deferral of the construction of the retaining wall along the east side of the alley in Block D in the referenced subdivision. The approved plans for the Park Place Addition required the alley in Block D to be constructed at an elevation which required a cut below natural grade along the east boundary of the Park Place Addition at certain points. Since there was no known time table for the development of the property east of the Park Place Addition at the time the subdivision was accepted by the City, there was established a requirement for a retaining wall to be constructed along about 30% of the east side of this alley after completion of the subdivision. Initially, this retaining wall was designed to be constructed of railroad ties. As you know, we subsequently approached the City and obtained a revision of the design of the retaining wall to a natural stone masonry design. Just prior to commencing construction of the retaining wall, we were advised that the property to the east of Park Place, being on the other side of the proposed retaining wall, has been proposed for development to the City. I have been in touch with Mr. Frank Bamburg who is the proposed developer of the adjacent property, and Frank is in agreement with us that the construction of the proposed retaining wall would be an unnecessary waste, and possibly a hinderance, since he is planning to go forward immediately with the development of the adjacent tract and would probably tear down the wall. It is my understanding that a zoning and plat application has been submitted to the City on the adjacent tract, which is now in process of review by the City. If the requests are approved, Mr. Bamburg has advised me that he plans to commence development of the adjacent tract in the early spring of 1992. In light of the foregoing, we request that the City defer the requirement that Park Place construct a retaining wall for sufficient time to determine if the adjacent property is going to be developed on this approximate time schedule. If for any reason the plans for the development of the adjacent property are either abandoned or delayed substantially, the undersigned shall still be responsible to construct a retaining wall as per the approved plans upon written notice from the City. However, if the development of the adjacent property commences as expected, the Park Place Addition shall be relieved of the retaining wall requirement. Mr. Gary Sieb November 5, 1991 Page 2 I have provided a copy of this letter to Frank Bamburg, and request that he confirm his agreement to you of this arrangement, which we have discussed by telephone. I would appreciate your confirmation of this arrangement as soon as possible as we have a negotiated contract in hand to construct the retaining wall, which I have put on hold. If the conditional deferral is acceptable to the City, I would like to notify the contractor as soon as possible. Please call if you have any questions.
