Box 478 Coppell, Texas 75019 Re: Construction of Road and Utility Improvements Park Place Addition and Heartz Road Dear Mr. Ratliff.' ~f As you know, the preliminary plat for the Park Place Addition has recently been approved at the request of the Park Place Joint Venture, and the construction of Heartz Road and its associated utilities has been previously approved by the City upon request of ABQ Development Corporation ("ABQ"), which is now under the conservatorship of the Resolution Trust Corporation ("RTC"). The Park Place Joint Venture has agreed to consider taking over the construction of Heartz pursuant to a recently negotiated agreement with ABQ and the RTC as their managing agent. As one of the conditions in the land acquisition contract for the Park Place Addition and for the possible assumption of the Heartz Rd. cons~truction, we need to obtain the City's confirmation of the matters described herein. The Park Place addition may be final platted in two phases. On the enclosed preliminary plat is marked the division line between the 1st and 2nd phases. The 1st phase will front on Sandy Lake Road and will be developed while Heartz Road and the utilities with Heartz are also being constructed by the Park Place Joint Venture. As a part of the Heartz construction, a new sanitary sewer line will be constructing a new sanitary sewer line in the Heartz right-of-way. The sanitary sewer service to the 1st phase of Park Place is planned to be provided through a sewer line which will be constructed from the west boundary of the first phase, across the 2nd phase land, to the new Heartz Road sewer line. The Heartz Road sewer line should be completed several months before phase 1 of Park Place is completed. The drainage facilities being constructed in Heartz Road deliver storm drainage into a recorded drainage easement which is for the benefit of ABQ, the Parks of Coppell Joint Venture and their assigns (the "Mutual Drainage Easement"), a copy of which is enclosed herewith. The storm water drainage from the 1st phase of Park Place is planned to be discharged at the west boundary of phase 1 into an interim earthen drainage channel, across the 2nd phase land, into the already existing interim earthen channel which is in the Mutual Drainage Easement. The Mutual Drainage Easement abuts the northwest corner of the 2nd phase land. In the next few days, our engineer will submit to the City a proposed Interim Drainage and Utility Easement which covers the location of the sanitary sewer line and earthen drainage channel described in the preceding paragraphs. Ratliff April 27, 1990 Page Two follows the alignment of Park Valley Drive on the preliminary plat since the sanitary sewer line and permanent drainage improvements will ultimately be located in that right-of-way when phase 2 is developed. We hereby request the City's written confirmation of the following: 1. Conceptual approval of the above described system for providing sewer and drainage services to the 1st and 2nd phases of the Park Place Addition. We understand that the City must review and approve the final engineering documents for such facilities, which will be submitted along with the final engineering for each phase of the development. 2. That the Mutual Drainage Easement may be used to provide storm drainage discharge points for Heanz Rd. and for the Park Place Addition. 3. That the approved plans for Heartz Rd. reflect all of the requirements of the City for the construction of Heartz and its associated utilities, that there are no further special requirements imposed by thc City on this project, and that the City shall accept the construction of Heartz Rd. as completed upon the performance of the work reflected in the approved plans in a workmanlike manner and in conformity with the normal city standards. If the City confirms that the above listed three statements correctly reflect the City's position, please so indicate by an authorized signature in the space provided below.
