Re: Preliminary Plat Second Submission

Dear Ms. Bowman:
On October 19, 1989 the referenced preliminary plat was presented to the
Planning and Zoning commission. Prior to that presentation, the plat had been
reviewed with city staff at two Development Review Committee meetings and had
been revised to meet all of the stafl~s requests up to the date of the meeting.
At the P&Z meeting, the Commission expressed a desire for the plat to be further
revised to provide (i) a street stub out to the east, (ii) a street stub out to the north,
and (iii) an realignment of one street to avoid having any lots which would back up
to future Heartz Rd. The Commission expressed a desire to see these changes before
sending the plat on to the City Council and explained in the meeting they were
required by law to act on the plat; therefore denying the plat without prejudice and
thus allowing us to make these minor revisions and re-apply.
From the context of these discussions, I assumed the plat would automatically be
carried forward to the November agenda. My engineer has today advised me you
have told them we cannot be on the November agenda since we did not make the re-
submittal of the plat by your deadline of October 18, the day before the P&Z meeting
at which we were asked to re-apply.
I respectfully request that you accept the attached re-submittal of the
referenced preliminary plat for the November P&Z meeting for the following
reasons:
1. I believe the request to make re-application was made on the assumption the
case would come back on the November agenda. The application deadline was not
discussed at the meeting and was obviously impossible to meet. If it had been
mentioned, I would have requested relief and I believe the Commission would have
granted it.
2. The changes that were requested, and which have been made, are relatively
minor. They do not require any substantial changes to lot or utility layout. Prior to
the October 19 meeting, the developer and staff had already reviewed the complex
elements of this plat and the remaining Development Review Committee meeting on
October 31 should provide ample opportunity to work out any details related to the
changes.

3. Removing the opportunity for this application to go to City Council in
December presents major difficulties in the business transactions of buying the land
and financing the development. These matters are conditioned upon an approval of a
preliminary plat for this property. The land contract places a year end deadline on
the acquisition of the land. The project could be jeopardized by this seemingly
unnecessary delay.
4. Judging from the October agenda, which contained our application and one
other plat application, the P&Z docket is not overloaded at this time.
