Stemmons, Suite 230 Lewisville, TX 75067 SUBJECT: HOMEOWNERS MAINTENANCE AGREEMENT - OAKBEND ESTATES Dear Derek, The Articles of Incorporation, By-Laws and Declaration of Covenants, Conditions and Restrictions you submitted for Oakbend Estates Addition, has been reviewed by the City's legal counsel, and was returned with the following comments: 1) There is absence of any language which provides for the City to access to the common areas, if the association fails to perform its duties and maintenance of those areas. 2) The language on page 12, section 3, entitled "Rezoning Prohibited" needs further clarification. The language should be reworded to clarify the fact that the restrictions apply to other members of the homeowners association and are not meant as an attempt to prevent the City of Coppell from rezoning the subdivision to a commercially-zoned area. Attached, for your use is a sample document for a homeowners maintenance assocaiation, prepared by our City Attorney's office. You may want to forward the document to your legal department for further review, and application toward the Oakbend agreement.
