Insomuch as Nikor Commerce Center has been developed and building permits and certificates of occupancy been previously released on interior projects for over 70% for the project, it is my understanding the City of Coppell will release the building permit for the above referenced interior finish provided the owner, ASG Nikor, Ltd. agrees to start the platting process. It is further understood that the Certificate of Occupancy would not be released until such time as the property has been platted and recorded with the county records. Please accept this letter as our acknowledgment that we have released our surveyor to commence the platting process, and will be submitting the application on Monday, Apd120, 1998. In Further consideration of the City of Coppell releasing the building permit in order to commence construction, Owner hereby releases the City of Coppell from any and all liability claims, and causes of action which may arise as the result of the platting process or delay in delivery of the Certificate of Occupancy as a result of the platting. We appreciate the cooperation of the City in this matter as we all try to meet the construction deadlines for the opening of the Coppell Child Development Center in June.
